We completed a residential insurance remodel job in 2016 and was not paid the insurance proceeds by the homeowner but we did enter into a payment agreement. They have now defaulted on those payments .

The answer to whether a valid and enforceable mechanics lien can be filed for work performed in 2016 is almost assuredly no. The deadline to file a mechanics lien for a residential project in Texas is the 15th day of the 3rd calendar month after the day on which the debt accrued. The date the debt accrued is defined as the last day of the month in which the lien claimant last furnished labor or material to the project.
