We completed a job approximately a year ago and the customer dragged his feet when it was time to pay. He always kept saying check is in the mail. Normally we would be on top of the lien but he's a friend of the family. So i go by and he swore up and down that the fence wasn't done and we needed to come back and replace a post and he would pay that day. We went back and replaced with a new post and concrete 30 days ago. Of course he says check is in the mail and it never shows. This is in Missouri. We already sent a notice of intent through levelset. Do we still have rights to file a lien?...Read More

I have a client that are not willing to pay us unless we reciprocally exchange check for unconditional release on final payment. We are located in California and I know that a Unconditional release will leave us without any rights if the check doesn't clear the bank. I hired a contractor to re-frame a roof and then do extensive renovations on a house in Arizona. This individual completed about 85% of the roof and then provided inaccurate updates as to the progress of the roof being finished and the renovations on the house. I live out of state and was unable to check on the status and ended up paying a little too far ahead of the actual work being done. In the end, I visited the property and learned that the roof wasn't completed and, despite his inaccurate updates, he wasn't doing any of the renovations he was being paid for. I parted ways with this contractor and he now needs to pay me back the $10,000 dollars I paid him for work he never did. He has promised to pay me back the $10,000 dollars he owes me and insists he will send the money but it has already been a couple weeks and I still have not received any funds from him. I would like to begin sending him weekly notices for the next three weeks before I send him a final notice after a month that I will be taking the matter to court. Is this something you can assist me with to send these formal notices? If possible, I would like assistance in collecting the money from this contractor. To complicate matters, the house is in Arizona but he is from St. Louis, Missouri. I have his cell phone number, email, and addresses for him in St Louis. I am not exactly sure where he is staying in Arizona. I would appreciate some assistance from your company in getting these outstanding funds collected. Look forward to hearing from you....Read More

i was leasing a building to operate my business out of in Alexandria LA, for approx. 3 years. after the first two which were within the original 2 year lease we signed the last year we opted to go month to month because sales were slow from that store and we could not seem to find good help in that area. I recieved a call from Troy Beauford the owner of that building and the owner of The Yankee Clipper landscaping which was a highly rated lawn service in that area. oy asked if I would like to buy the building and I declined . He then asked if he could show building to prospect buyers and I stated only if he accompanied them when in the building due to all the inventory and equipment we had at that location. he agreed . about 3 weeks went by and I recieved anj e mail from a giuy named ricky ferris and he stated he was the new owner of the building and would like us to send the rent checks to him instead of troy. I called Troy and he confirmed, but i was ready to pull out of Alexeandria La all togeather and focus my business where revenue was coming in. I informed Mr. Ferris and he was upset but nothing he could say . we gave a 30 day notice and when time came to retreive our stock I had hired a crew and moving truck and sent them on a 3 hr trip to Alexandria. When they arrived at shop locks were changed and M r. Ferris was not their like he promised to let s retrieve our belongings. Mr Ferris was reached by phone by Corporal Flynn of Bienville sherriffs office whch I had called for assistance when the moving crew informed me what was happening. Mr Ferris told the Corporal he wanted 3k to release inventory and the corporal told him he cannot hold our belongings hostege and if he felt we owed him money that would have to be done in civil court and Mr Ferris reluctantly agreed and said for me to call him and we could arange another day to meet him to nlock building to retreive belongings which included new and sed equipment for industrial/commercial cleaning applications ,Chemicals,office furnature,signage,kitchen furnature for break room a overnigtht queen futon with wool matress, and 2 offices full of furnature along with our air compressor, fork lift, and all wi fi equipment and computers everythig we needede to run our business in excess of 50k. Well Mr FERRIS dodged my calls and e mails for about a year so I called previous owner that I had made the original deal on trhe lease and troy stated that he would be found liable because he led M r. Ferris to believe we were the perfect tennant (never late on rent,fully insured, and the amount I paid for rent would more than cover his mortgage. When that didnt happen Mr. Ferris retaliated by keeping our belongings. Now I think they are both at fault but Mr. Ferris is the bully in this trying to get something for nothing and now he states all our belongings are not there because he leased it out to another company and he said I would have to get with them but they said they have no idea where my stock is. Now Mr Ferris playing molew again and cannot be reached. Troy Beaford started this mess and Mr. Ferris endxed it by stealing over 50 k in stock and belongings. If you filed your pre-lien notice on time and ready for a mechanical lien but have done more work since that isn't within the pre-lien notice can you include all of the amount on your mechanical lien or only the amount that the notice has been given?Just interested in how the mechanical lien falls if you have filed your notice and it is time for a mechanics lien and you have done more work and the 3rd month hasn't gotten here yet to file your pre-lien on the new amount. Can you include that on your mechanics lien or do you have to file another one when the 4th month arrives for that work that has been completed....Read More

I am a Dump truck company, I was working for a subcontractor and we signed a contract working by the hour. Come to find out the sub was getting paid per load, and the contractor only owes then $48K. the contractor has been talking to me and they said they will give me subs check so I can square away some owner operators. I don't think they will make me sign a release. Contractor states take check and go after sub and collect the rest. So my question is: Should I take the check as a partial payment and still go after bond to place lien. or by taking check will it affect me collecting the open balance?
