In short, our project was delayed substantially by the General Contractor’s poor management. Consequently, our portion of work (Drywall & finish) was severely delayed and we were forced to by verbal directives to accelerate, and incurred substantial OT costs. We provided a notice by email Aug 7th of our intention to charge for our OT and delay costs, however the General Contractor did not respond. By project completion we had accrued $36,295 in costs. We have submitted a Change Order request, but General has rejected it, reasoning we had not submitted on their weekly forms reports and had each week approved. By Iowa statue our deadlines are fast-approaching and we intend to file on retainage and amounts approved however; My question is this, notwithstanding the arguable contract language which our attorney has determined may or may not apply in the case of the delay claim, and we intend to argue, could this in any way be construed as a frivolous lien if we included this unapproved amount $36,295 and filed?...Read More

Contractor wants full payment for a job he did not complete. Don't have an issue paying for the part that he did but won't pay for what he didn't. Husband wasn't thinking and didn't get a contract signed. but we have video and photo documentation on what wasn't completed. Contractor is threatening a lien on the property. We have also told him we wouldn't pay him until Tomorrow 5/3/2021 as that is when our Hard Money Lender issued the draw for. Contractor is wanting money for supplies and labor, but he didn't purchase materials as someone else purchased the materials and we are paying him directly for the material cost. What are our legal actions. Like I said we don't mind paying him for the labor, but he didn't actually do the labor it was a roofing team that came and did the half that they did. Contractor Texted husband on April 29,2021 stating that the roof job was complete. Husband and I went out to property to find that one of the side roofs and the back roof of property was not completed. We were ripped off for a HUD Modular, 28' x 60, as stated on the mortgage papers, we signed. We received a 1600' foot, generic manufactured HUD house, built with RESPA violations, from day one. The mortgage was conceived without our knowledge, consent, or want of a manufactured home. We paid $168,500.00 in 2007. We owe approximately $190,000.00, after paying. I reported the builder and Wells Fargo bank and now, as senior citizens, we are ruined. Since the house wasn't built to RESPA code, which is not allowed to proceed. After all, the reporting of fraud, HUD, Wells, the State, everyone says, "Gee, I'm so sorry". We are seniors, my husband 71 is still working. We can walk away from $190,000.00 un-paid debt, that's it. The house is collapsing on our back wall. The house is worth $80,000.00. What do we do?...Read More

I purchased windows from Mad City windows and complaint time of install but the foreman said the windows are fine. I asked a window to be replaced and they never seem to order the replacement window ever. I have 100% documentation that the windows were installed incorrectly by thermos camera had ice build up on the windows during the window. I work for a GC. I filed a Claim of Lien for a Job on March 18, 2021 and sent a copy of the filed Claim via Certified Mail to the homeowner that day. That copy was returned to us today, without a signature and the note "RETURN TO SENDER UNABLE TO FORWARD". My question is, does the copy of the Claim of Lien filed have to be sent and received with a signature by the homeowner, or can I simply send it through regular mail, or do I need to put in a different envelope and resend it Certified again....Read More
