I am a subcontractor working on a construction job (restoring a historic building) for a General Contractor in Temple, Texas. This General Contractor actually owns this building. We have never worked with this general contractor and want to make sure we are protected. Do we need to file a pre-lien to make sure we get paid? I started a fintech company named PayUp, that does invoice factoring in Real Estate. I spoke to Frank and he asked me to put my question on here so that we could get it clarified. 1) We want to know our legal mechanics lien rights as an invoice factoring company if we are purchasing invoices after job completion (therefore cannot send intent to liens before the job has started etc)? 2) Can the mechanics lien be batched by selection of invoices, or does it have to be on every invoice? 3) We currently work in Texas, Florida, NC, & SC but plan to expand throughout the US - which states does this cause an issue with, and which states are we good to purchase receivables whilst maintaining lien rights?...Read More

I just spoke to someone on the phone at Levelset that confirmed the prelim had been filed and has been faxed and emailed to the GC. Hello, I would like to have a better understanding on how often we should send non-payment notices in TX. For example - if work has been done in July and August of 2022. July non-pymt notice was due by the 15th of October, (and imagine it was sent); and August is due in November. So when we ready to send August non-pymt notice by the 15th of November - do we need to sent July notice again or should we only send it once (which imagine was already sent in October) ??...Read More

The homeowner messaged me to release funds to the sub, the sub-contractor misappropriated the funds and the homeowner came after me and won. What repercussions will this have on my license? I worked on a project for 8 months, it was the in-laws home that needed some repairs in order to be put on the market to sale after their passing. I worked with my soon to be ex-husband on the project. It was a verbal agreement that if i helped him getting this house ready To be sold- when it did sell- he would give me $10,000. The house sold Nov.1,2022. I have not heard a peep from him in regards to me being paid. A few months back he made a statement that he was giving me anything, that i owed him for other things that he started to rattle off. These things he stated had nothing to do with this house and besides....i dont feel that i owe him anything to be honest. With that being said- this verbal was for the job not by monthly payments as the examples show. What do i nees to do here to get my money? He also had me charge stuff on my home depot account with assurance of being paid. 1300.00 be be exact. Not one penny haw been applied to that....Read More

This project was done for the housing devlopment. The developer was listed as the owner. Because it had a street address when that home was sold it was marked as possible residential. We are now being told we have no lien rights because the last notice sent should have been residential not commercial even though the work was not just for the house it was for the entire development. This raises concern for the multitude of jobs we have for new housing development. At what point if any should this have been listed as residential? I have mechanics lien on my rental (non-homestead) in Texas. Upon research, the sub did not give me any notice so I am assuming he did not "perfect the lien" The lien will expire in about 6 weeks as he filed it last year. How do I go about getting it off my record once it expires as the sub is refusing to remove it even after I pointed out he didn't follow proper procedure (not to mention I had to have his work COMPLETELY redone)?
