Can I file a mechanical lien if I did not send a preliminary 15 day after the materials and labor started. I moved from miami to do a project with some family members, one of them being my father who has two other siblings. The estate holder was my grandfather who passed away and deeded the land over to his three sons. Two of which wanted nothing much to with the land other then sell it. A deal was out in place between my father who worked it with his brothers as they were to be splitting up the estate. A verbal agreement was made in which I was suppose to purchase the property and cash them out. In the mean time I also agreed to move from my home in miami and come up and manage the property as the project begins. I ended up doing all the work my self and spending my personal money in materials labor meeting with the county and pulling permits. Long story short as the brother were dealing probate we were not able to close. As time went on as spending my personal money on the project. And doing the labor my self they decided they were not going to inform me and list the property now as I found out when a realtor told me that the brothers told her I was living here with kids in school and I knew that they listed it. Which I did not because no one had returned or picked up my calls. Would like to know what options I have here in this?...Read More

I am owed $30,000 total. The Owner knows that they owe me $30,000 in total.I have placed a $30,000 lien on each of nine (9) unsold townhome units and I wanted to confirm this is OK or whether I should have placed a $3,333.33 lien on each of the nine (9) units? I'm a subcontractor, who recently finished trim work on a new construction project, that's owner occupied. This gets weird. The homeowner is supposed to have a general contractor as required by their bank for the construction loan they took out. I was hired who I thought was the GC, only to find out he's not the GC. There's no GC on the job. Now the guy who hired me is not paying and told me to speak to the homeowner about my invoices. The homeowner says the guy posing as the GC is responsible for paying me, but he's not a licensed GC. I need to file a lien, and in this case it should be able to go against the homeowner and their property since there is no acting GC? Correct? Also since I'm a specialty/subcontractor is there flexibility with sending a preliminary notice? Can and should I still send that?...Read More

I am a homeowner who hired a contractor to do some work, after the work is complete and I have fully paid the contractor I find out the plumber a sub of the contractor is owed money. That Sub has now filed a lien on my property. Is he allowed to do that even when he knows the prime contractor has been paid? The sub is also demanding I pay him an extra $200 for his troubles to release the lien, do I have to do that or can I just pay him what he is owed and ask him to release the lien?...Read More

I was dating a woman and at the same time was working on her house in Charlotte that she is going to re-sale , I put in over 300 hours to this job and used my pickup truck to haul materials and I supplied materials for this job, the deal was once she sold the place we would buy another home which we have looked at already , purchase it , and repair and remodel and sale, all the heavy dirty work to this place is done and at one time I was wearing a hazmat suit to clean part of the place out, it was built in 1934 but close to downtown Charlotte, last week she decided she didnt want to see me anymore, then she said she was not paying me for any of the work I have done, she said i didnt go to church enough and that I didnt have a 40 hour per week job or insurance,,,,,thats how it stands now, no communication, fact is i work with my son but its not with a big company and alot of our jobs are cash/insurance for damaged homes, I also live in Belmont NC and my home would sale 400,000 plus in a couple hours so Im no broke trying to rip someone off, I have witnesses who will testify my time at this home and she spoke of how after she settled with me she would still make out great on this home, she has less than a 100 grand in it and has turned down 250,000,,,thank you. ...Read More

I had a new roof and gutters put on my house. Bulldog Construction in NC was the contractor who I signed the contract for. Bulldog Construction then subcontracted the work and they got it done. Bulldog was then paid in full. Apparently Bulldog then failed to pay his subs and now they are showing up at my house saying they will put a mechanics lien on my house. Is this possible?...Read More
