Hello. A builder built a home next door and changed the grade in Saint Louis County, Missouri. There was several damages done to our property due to this change. We are in a lawsuit, and cannot find where to go to get help. The swale was removed and changed the direction of the water that affected our property and the natural water flow. Hello!
We are the original contractor and sub contracted a job out to someone else. They have crews that then perform the job that we had subcontracted out. Upon completion, we the original contractor paid the subcontractor that we hired. We were contacted by one of the crew members of that job about how they were going to file a lien against the homeowners house because he was not paid. After speaking with our subcontractor he stated that this particular individual was high on the job site and was only there for 4 hours before he voluntarily left the job while it was still in progress without telling any of the other workers performing the job. He is threatening legal action against us along with putting a lien on the customer's home. No contracts were signed by the subcontractor and us for this job. What are our options? Are we liable? I'm not being fully paid on a residential project. I reached out to the owner of project and advised a lien would take place. I was advised a full lien waiver was signed by GC on job. The GC did make a partial payment to us but we never signed a waiver or was even asked to sign one. The owner basically told us there is nothing we can do to them and they aren't paying any thing.
