2 occurance with GC not paying us on time. Payment was due April 14th. Email Owner and GC to let them know that we are moving forward with lien if no response by May 19, 2002. Owner has terminated GC and is doing an audit of accounts. Owner responded saying the following: "I’d ask that you not please lien us just yet, we need time to work through the issues, but if you do lien us, we’re going to bond around the lien to buy us the time we require to finish auditing the project."... We hired a contractor to finish up a kitchen remodel project. Install counter tops, and appliances. He brought by samples of counter tops and we picked one and he instigated the purchase. Counter tops were paid in full to the contractor. I just received a letter from the countertop supplier that he was not paid in full and wants to place a lien on my home for the remaining balance. We have had no dealings with the supplier at all. Only the contractor, who picked the supplier and paid them the deposit I guess. We have no idea of the deal between the two parties. Are we liable for this. On top of that we fired the contractor prior for spotty work. I am currently suing him for the balance I had to pay another contractor to finish. ...Read More

I hired a tree mulcher to clear my overgrown property but he left it in a much worse state than when he first started. He cut and left a lot of tree trunks that were not mulched. He really did a bad job and I have pictures to prove the before and after of what he did. When he came to collect his payment, I complained, but he was not willing to either take a cut on our agreed payment or come back to clean up his mess. I ended up not paying him and he threatened to lien my property. Last December, he filed a notice to lien which I contested and today his lawyer sent me another claim of lien. Do I have to file another contest? I don't understand why he would do it twice. Shouldn't he be moving forward and file a lawsuit at this point? I'm lost and needed help on how to proceed. My company a Roofing Contractor and we provided a compiled service of roof inspection and assisted with the claim approval process for a customer's roof replacement. However, once the roof was approved by the insurance company the customer did not want to have my company replace the roof because he wants to keep the depreciation funds paid by the insurance company. There is a clause in my contracts that states "There is a $500.00 cancellations fee once the contract has been signed" The contract was signed at the beginning of the process. What recourse do I have to get the $500.00 fee? Can this be put in Levelset with an intent to place a lien?...Read More

We are a company that does remediation of property when there is a suicide, etc. This particular situation, someone committed suicide and called us for clean up. We always get homeowners insurance info from the owner and have them sign a consent for us to be paid by the insurance company. They gave us the company, which we called. We have the agent that has their insurance but the homeowner has to start the claim. We have called and left many messages for her to call as well as email her. She has never responded until we had you guys send a letter of intent to lien. We would like to know how we should respond to the email she finally sent back....Read More

We have a construction project in Georgia where we are submitting monthly pay applications. We have not been paid on application #2 and it is nearing 60 days from the time the application was submitted, however an interim lien release has not been requested for that specific pay application. Since the interim lien release was not requested or completed for this specific pay application how long would I have to file a lien or notice of non payment for this pay application if interim lien releases have been filed on all other pay applications for the project?...Read More
