Trying to figure out how to deal with a delusional GC who thinks we owe him money for work he has not completed
Hello. I am an attorney who practices extensively in the construction industry. The lien constitutes a cloud on your title that would cause a problem if you needed to sell the property or even obtain a second mortgage. However, if you are planning to stay in the property for at least a year, then the best course of action may be to do absolutely nothing.
The next step would be for the contractor to bring suit. Unless that is done within one year, the lien goes away automatically. If a suit is filed, then you should obtain an attorney immediately, and I would be glad to assist you.
If you wanted to shorten the filing period, then you would file a Notice of Lien Contest. For that, I would once again recommend that you seek legal guidance.
