We have a customer that purchased materials. They have yet to pay us on the account. They forged an unconditional release of lien with the signature and notary stamp and provided that to the general contractor. The GC is extremely upset that they paid a scam artist company. We are a fuel company that supplies fuel to businesses (for generators, etc), contractors for machinery while on the job, floating vessels that come into local marinas. We want to start filing NTOs but we are unsure of how to file against floating vessels, or if its even possible. Also, if the construction companies are doing new construction, who would get the NTO if there is no property owner yet? Also, some companies we supply, we are only fueling their on site fuel tanks so it is a mobile customer of sorts. We are a solar contractor who would be working with our customer to install a Photovoltaic System but the homeowner decided to cancel. We have a signed contract that stipulates if she cancels after our cancellation deadline, she would be charged a cancellation fee. We also have a signed Notice of Commencement that has been notarized but not yet submitted to the Clerk of Courts for recording. On July 2020 we entered into a Contract with a General Contractor : on the Project Silver Hills at Fort Myers. to build a Swimming pool on that property. We conclude our project successfully, on 04/06/2022 after having notice of the termination and seeing slow payment we sent an Intent to lien to the GC and the Owner since we were demanding our retainage and other small invoice for the total amount of $15K. We received an email on 04/07/2022 from the Owner letting us know they terminated the contract with the GC and wanted to assume our contract on the same conditions of the original contract.
