We are a contractor and I finished the job in Minnesota on August 12, 2021. I am coming close to my 120 days and I would like to file a lien against the property we remodeled. We did not send a preliminary notice at the beginning of the job. We have done several jobs with this customer and never had a problem in the past and did not feel it necessary. However now we are unable to collect our money on the project. Am I still able to file a lien?...Read More

My company is in the construction industry. We are often asked to sign unconditional waivers saying we received a check, when we actually do not have it in our possession, for them to release the check. We offer to sign a conditional waiver to allow them to release the check and will be happy to sign the unconditional waiver once payment has been received. Is a scanned copy of the unconditional waiver enforceable or are we protected until they have the original? I don't see how they can force us to sign a document saying we have payments we don't have. And does this vary by state? We do business all over the US. ...Read More

The owner is now disputing a construction defect which is caused by his designer (i.e. architect of record), and forcing me to correct that defect with no intention to pay me. I asked him to reach an agreement which will clearly spell out that I will not responsible for the design error or he is going to compensate me for the fix. We are a custom product manufacturer and provided product to a county school board in Florida through a direct purchase order. Even though the county is to pay for the product, a subcontractor provided all of the projects final sizes and information and installed the product. There is also a GC involved. Are we able to file a lien against the school board? They are withholding payment due to an issue that all parties bear some responsibility. The invoice is dated 9/27/21. On October last year my boss sent/file the lien affidavit and claim. Customer never paid and now his lawyer contacted us saying that if we do not release it they'll proceed to file a suit. We began with the lien notice, then they said that it was invalid and then the lawyer we were working with said that it was really valid our petition. Please , I need some advice here We are a mechanical HVAC contractor. Client refused to pay because we supposedly didnt comply . We proved that we were several times at the jobsite and customer wasnt ready for us to continue, so when he was actually ready we couldnt make it next day as he was requesting.
