If we sign an unconditional waiver and release on progress payment for our March pay application invoice, are we waiving our rights to anything still owed prior to that? They have paid March; but not February. If we sign the waiver for March, do we have any lien rights for our February billing?...Read More

I am a contractor out of South Carolina and we do a large range of service calls through leads we get from the Handy Technologies company, however we have not been paid for many many jobs that have been completed. They try saying its because homeonwers never marked the jobs as completed on their app or whatever. Even right now, we have done thousands of dollars this week, worth of work for the lead company yet havent been paid any of it. What is my option to enforce payment, and basically let them know we do not play around when it comes to non payment. They get leads from HomeAdvisor as well. Many times we have been stiffed through them even out of our estimate costs. We charge a 100-150$ fee to even come out to the home or property, as it weeds out price shoppers and tire kickers. Yet the homeowner just cancels the job and claim nobody ever showed up. Ive got gps trackers on all our company cars and know when people show up to addresses. Would an attorney who knows about the suits against Handy Technologies, be able to help me? They are a good stream of constant service call work, but their payment issues arent good. If someone can help, it would be appreciated. Yall are more than welcome to email me at info@bhrconstructionco.com I really want to get this bs resolved. I dont work for our clients for free, but Handy Technologies has screwed us out of so much money. ...Read More

I let a guy stay at my house for no rent and he is doing work on it. Not paying him, no contract, no limit on the upper end of how much work he can do. I supply majority of parts/supplies. He never sent me the intent 5o lein paperwork. He just filed a mechanics lein 3 days before I signed a contract to sell the house so title search kicked up the lein and I can't sell now. What should I do...the mechanics lein is bogus and he is fraudulently filing the lein...Read More

I am in the process of selling my home and the title company found a constitutional mechanic's lien filed on it by a roofing contractor I used. The work was contracted (signed contract by me), deposit paid (half of contract amount) and finished (not 100% per the contract) in 2016. I discussed, lack for a better term, the final payment with multiple people in their office until August 2017 as the contractor was claiming I owed more than contracted. I learned of the lien filed in June of 2018 when the title company researched for the sale of my house the week of January 13,2020. A few questions: (1) when should the lien have been filed?, (2) should I have been informed at the time of filing?, (3) how do I get it removed since the amount is fraudulent compared to the contract? and (4) should I counter to get the lien removed to pay the amount owed, minus the unfinished work, per the contract? Need immediate help as my house is under contract. Plus, I worked really hard in 2017 get a final payment that aligned with my contract from the roofing contractor (I have documentation of the complete transaction from 2016 thru 2017). I believe their claim is fraudulent and they're being dishonest. Lastly, I just got back to work after being unemployed for a year so money is tight. I could really use your feedback and guidance soon. Thank you, Erin...Read More

We are a sign contractor (subcontractor to a national sign company who contracted with the client. We took too long to get set up with LevelSet and missed our prelim notice window (job started on 2/15). Our invoice is now past due and our customer is not returning calls. We made contact with the client directly and their legal dept is "looking into" direct payment to us. I would like to apply pressure but not sure what the best way to do it....Read More

We are a fuel company that supplies fuel to businesses (for generators, etc), contractors for machinery while on the job, floating vessels that come into local marinas. We want to start filing NTOs but we are unsure of how to file against floating vessels, or if its even possible. Also, if the construction companies are doing new construction, who would get the NTO if there is no property owner yet? Also, some companies we supply, we are only fueling their on site fuel tanks so it is a mobile customer of sorts. Can you help us figure this out so we can get started protecting our payment?...Read More
