I filed a lien on a job. Now all of the sudden my contractor wants me to sign a lien waiver because the bonding agency, owner, general contractor, and material provider all are trying to get paid. My contractor sent over a lien release form. Do I legally have to sign and return this form without being paid first? My concern is that if I sign this the contractor will not provide the check owed. As he is delinquent on another invoice for another job. I am in another state working right now, so doing a person to person exchange is not possible. What are my options. I had my roof replaced October 1st, 2021 after a large hail storm hit my area. I contacted my insurance company and then hired a local Roofing Company to replace the roof. I paid the full invoice amount for the completed work and materials in the amount of $13,533. Last week, I received a certified letter with a Notice of Intent to File a Lien Statement on my home by the roofing material supplier in the amount of $4,681. I have attempted to reach the roofing company to find a resolution to their delinquent payment practices, with no response. Wondering what my options are or if I am liable in the State of Colorado since I paid for everything already and this a "Full Price Lien State"? I am coming from the other side, where we signed an estimate, they began work and collecting funds but never gave us any sort of pay schedule. Or breakdown as we went. Then, out of the blue, I get an email saying they messed up and should have been collecting all along and expected me to write a check for 15k, on the spot. Then they stated that "Oh yeah, and there is the final payment due too ... so can you write us a check for 20k?" I said, "Sure after I get an invoice showing me not only how we got to the ESTIMATED cost but then went 12k over that estimate." There was 1 change order that was signed off by us. The rest that they are claiming they cannot legitimize. Every attempt I have made to try and discuss this was thwarted and now they have a lawyer coming after me. HELP! I want this to be in good faith but they didn't even pull permits and they are claiming that we owe them for that, is it is in the estimate. I am a home owner in El Paso County, Colorado. I had a detached garage built recently by a general contractor. He sent me a contract with the amount I was to pay, the scope of work, and a few terms and conditions mainly concerning change orders during construction. I signed the contract and returned it. Nowhere in the contract were any provisions to pay more than the agreed upon amount - no clauses about unforeseen inflation, supply delays, labor cost increases, or material cost increases. No clauses about the home owner liable for cost overruns. If there had been I would have asked for clarification as to my final liability or I would have refused the contract. Can the contractor file a valid lien for cost increases out side the terms of the contract? I have fully satisfied the terms of the contract and change orders on time and to the best of my knowledge, the GC paid the subs. Greetings I'm a homeowner who hired a contractors to do work after Hurricane Ida on my roof. I paid the deductible which was a down payment for the project. I also paid the remaining balance for the roof to the contractor per my insurance check. I received a lien notice on my property from the company that provided the materials for the roof.
