Do I legally have to sign a lien release waiver if i have not been paid anything for services rendered?

I filed a lien on a job. Now all of the sudden my contractor wants me to sign a lien waiver because the bonding agency, owner, general contractor, and material provider all are trying to get paid. My contractor sent over a lien release form. Do I legally have to sign and return this form without being paid first? My concern is that if I sign this the contractor will not provide the check owed. As he is delinquent on another invoice for another job. I am in another state working right now, so doing a person to person exchange is not possible. What are my options. Thank you, Daniel Krek

You are not obligated to give a lien waiver in advance of payment, and, in my opinion, it is foolish to do so. I recently recommended to another contractor in the same situation that he should contact a paralegal service where the GC is located to handle the exchange of your lien waiver for the check. The paralegal service acts as an escrow agent.
