Hello, I am a subcontractor on a large commercial project. One of my third party suppliers submitted a notarized mechanics lien letter (it was not a notice of intent) to the recorders office during the holidays. The owner of the property has informed the General Contractor that they will not be paying ANY funds for October and beyond until the Release Mechanics Lien has been filed and the lien has been Officially removed and Recorded (which can take months, especially during times of Covid-19). Is it within their legal right to hold payment to the General Contractor and consequentially all Subcontractors on this project, if Unconditional Progress releases and Unconditional Finals for the supplier who filed the lien have been provided? ...Read More
I am a tile setter who started a job, got injured on the jobsite, then the customer moved up the completion date. Because I could not finish timely now, the homeowner threw me off of the job. There is a written quote for the original work to be performed along with an invoice of what was actually completed. Although the original quote was never signed as they live out of state, I have copies of daily photos and text between us showing what was/had been accomplished. The homeowner and I came to an agreeable amount of compensation for what had been already completed. However, the home owner has yet to satisfy this agreement. I am a sub for a GC and just got a request to sign and notarize a Partial Release of Lien which reads: "The undersigned lienor, in consideration of the sum of Check #5090. Received, hereby partially waives and releases its lien and right to claim of lien for labor services and/or materials Furnished through November 23, 2020...." We are a subcontractor on a public project in Fairfax VA for the Fairfax County Housing & Development Authority. The GC is based out of Maryland. The current Balance is $93k. GC is insisting we sign an Unconditional Lien Release in order for them to release payment. (They are paying 95%.) They will not accept a conditional release. Terms of the contract state "all Waivers of Lien and Subcontractor’s Affidavits shall be in a form that is acceptable to GC". I am not giving up our bond claim rights without having payment in hand. Job is bonded but we failed to send the required Preliminary Notice. Can you advise a way to proceed? Thank you in advance for any help.
