We are splitting time between two homes. We claim one home as our homestead for taxes. We had a general contractor working on a metal building on our second home (25-60% residence over the past year). We do not have a written contract. He is threatening to put a lien on our property because we are terminating our working relationship due to his refusal to take our calls, answer our texts, or come to our project site. We are trying to compromise with him based on our out-of-pocket costs to remedy his construction errors that do not meet code, but he will not budge. (Straight math: what he wants us to pay minus what we are having to pay other contractors to fix his errors. We had already paid in full for the part of the project that included the errors that have come up in inspections.) Our understanding is that a written contract is necessary for a general contractor to take out a lien on a homesteaded residential property...how do we know if we clear that bar?...Read More

We hired a prime contractor for siding, they subbed it out, we didn’t even know until they fired the crew for gross negligence and mistakes. Job finished within that week, we paid in full. A month and a week later sub filed a mechanics lien on our property. Why would we be expected to pay twice? Let’s say a homeowner pays the original contractor in full, but said contractor failed to pay his subcontractor. You say no lien can be filed above. But could the subcontractor file a lien against the property owner anyway, even though they aren’t financial liable? Could a lien be used as a form of weaponizing the legal process to extort monetary concession from a homeowner that had already paid the original contractor in full? I'm in a mess, my future hope's and My friend is just a lie. A friend of mine came to me and offered me a opportunity to start flipping houses with him and he was working on one that he could use some of my help with. I've worked for him before on his house that's how we met. I was working for someone at the time and was able to work on my time off. And I needed a place to stay, So he told me that I would be able to stay in one of the bedrooms while he and his boys will be in the rest of the house. Now that the work is almost done he has completely changed his tone and I'm afraid he's going to change course and just leave. We're supposed to put this place on the market and move to the next place. But there is no other place. I've put a lot of time in this place and even lost my other job just to satisfy him and show my eagerness to flip houses So if he wants to change his mind and not need me anymore then I will have to charge him for all the work I have done...Read More

Hello, I had a contractor pour concrete to make a patio in NC . I paid him full in cash. That contractor had subcontracted to 2 more subcontractors above him (so contractor doing the actual job, another subcontractor and then supplier above him). Now concrete supplier is saying he will put a lien on my property for 3K payment he needs for materials. Can supplier put a lien on my property or is there another way to get out of this double payment without much headache? My husband and I did major repair & remodeling work on a home that we planned to rent from a (former) friend. The original oral (I know) agreement was that our labor and materials expenses would be used toward our rent - so no rent to pay for nearly a year! However, once we finished the remodeling, my husband got a new job that required us to be closer to his work. So we opted to move into a different rental. How do we get repaid for all the labor & materials we paid for to fix up our former friend's house? It was about $18,000, so not sure how to do this. Hi, I am busy studying engineering law and standard was given the assignment for a turn key project for a new mechanical workshop that is nearing its hand over stage and the installation contractor has informed the engineer that the workshop's electrically powered(pendant controlled) overhead crane installation has been completed. The above overhead travelling crane is fitted with a single hoist that has a designed lifting capacity of 5 metric Tons and its lift is 6m. The crane's traversing bogey has a designed cross travel distance of 7,5m and long travel distance of 25m. Now the engineer instructed me to draw up a punch list of outstanding items for the hand over and acceptance of the above overhead crane installation from the contractor to the company. Assuming that the crane's concrete foundation plinths have already been inspected and accepted, i should now describe the structural and other installed components that i will inspect as well as the test and other records i will call for in order to carry out the engineer's instruction. I started working for my friends remodeling company, "TOTAL TOOL BOX". We worked well together and we're building the business. I took 45% of all contracts while he took 55%. Well on our last job he took all the money and didn't pay me. I did over 90% of all the work that had been done. My property has an HOA. The HOA hired an architect to review plans for construction of our home. After paying the base fee to the HOA and requesting detail on the architects overages, the architect decided to double his original overage invoice, issue a new invoice for services we did not request, and is threatening to file a lien against our property if we don't pay up. I am a water mitigation and mold remediation contractor and performed work under contract by the home owner. This client has insurance coverage which cover catastrophic loss due to hurricane Ida. The insurance company has passed their deadline per Louisiana statute and work has still not been paid. An intent to lien was sent on 10/27/2021. The insurance states that they need to send my estimate to a 3rd party for peer review, but this was said to have been sent on 09/30/2021 and an update was requested by the carrier on 10/13/2021. Now on 10/28/2021 they stated they need to send it in for review. I have all email communication between the insured, carrier and myself....Read More
