I have a punch list of 4-5 items to be completed to our satisfaction, I.e., cracks in wall (3), dishwasher not fully framed in and you can see into top of dishwasher ( contractor said pay us and will come back and trim it?), ceiling has 4/9 sprinkler heads with cracks and uneven marking around 4 rims (eye sore’, bowed wall byHVAC, front door key latch needs to be moved so outside hallway light doesn’t show through into condo, HVAC., missing about $600 of floor tile and door hinges from villa (contractor said he would investigate), no response? Contractor stopped sending emails in July. Only communicates via email and no follow up photo’s. COVID has kept us from SC age and health concerns.
Legal advance shared 4 months ago, require the GC to complete the punch list before final payment ( paying the final brill and trying get the project completed would require more time). SC contractors have not been reliable and difficult to find qualified people to complete a project.
If the GC files a lien without providing proof of completion? What is our options to resolve to our satisfaction.
The permit understated the cost by $20,000, did not include HVAC work, and did not have the fire department inspect the sprinklers required once installed (GC didn’t have a full understanding on rules for condos when sprinklers needed to be updated).
Please advise corrective action.
South CarolinaWe have completed a project for a commercial project. First payment was paid with no issues. Second payment was 21-30 days late depending on what type of grace period you are willing to give. Our third payment is being held up due to not being able to provide supplier lien waivers. I explained that if the second payment had be paid when it was supposed to our supplier would have been paid. The third payment was going to be used to do this. They only want to release enough monies to pay our suppliers then release the rest later. There is wording in the contract about supplier lien waivers but there is also wording in the contract about the contractor and owner not being held liable for a sub not paying their supplier bills.

LouisianaI am a sub and I now have 2 monthly pay apps pending payment. The GC needs conditional partial releases for each pay app with the amount owed and the monthly thru date they represent. I was wondering if I send both releases and they pay the later month and not the previous month will I release my financial lien rights for the previous month with the later months conditional partial release.
FloridaI am a property owner who has been having some work done on our master bedroom area of the home. We've experiencing some difficulties from our general contractor and subcontractors for this project, which has turned into a month-long pain (we were told it would be a 3 day project). It is apparent that the general contractor is having communication problems with both us and his subcontractor, with everything from ordering the wrong materials (materials that are still at our house), failing to protect our wood floors from contruction debrais as promised, and more. While we are now at the tail-end of everything being completed, we are worried about the potential of a lien from either the contractor and/or subcontractor upon our final payment. Can we request a lien waiver from all parties involved and how should we go about doing so?
Our contract has some language which says: "This agreement and all rights and liabilities hereunder shall be governed by the Law of the State of Georgia. In addition to all other remedies provided for under the laws of the state of Georgia, Contractor hereby notifies the owner that pursuant to O.C.G.A. 14-14-361-et. seq, contractor has certain lien rights with respect to the real property on which services, materials, and installation were provided for any amounts, which remain past due."
I'm not entirely sure what that refers to and would greatly appreciate some insight.

WisconsinWe are a mechanical contracting vendor. Sub to a sub-contractor. It’s common to sign lien releases before getting paid.
MarylandGeorgia Lien Waiver Question....When completing a Georgia Lien Waiver it indicates for us to List the State as Georgia and Name the County. The work is primarily happening in WI and then we are shipping the modular unit to Georgia for final install. Should we be listing where the work is being performed or where the Project is located? This is a private project and we are a GC.

CaliforniaI work for a contractor who has worked on a residence without a general contractor or any subcontractors, just our company. We did not hire any external laborers for this work, we only sent our full-time employees to the site to perform the work. The Homeowner is requesting a lien release from the workers stating that they have been paid. Should the conditional final lien release from my company cover our full-time employees? Or should I have each full time employee that worked at the residence complete a lien release stating they've been paid by my company?

FloridaWe filed a lien on a job for over $240k outstanding. We have a check on the way for $20k and the customer is asking us to sign an unconditional progress waiver once the payment has processed. However, we absolutely do NOT want to give up our lien rights on this job and the rest of the amount owed. Will signing the unconditional progress waiver affect our lien on the rest of the amount owed?
