Filling out a Georiga Lien Waiver

Georgia Lien Waiver Question....When completing a Georgia Lien Waiver it indicates for us to List the State as Georgia and Name the County. The work is primarily happening in WI and then we are shipping the modular unit to Georgia for final install. Should we be listing where the work is being performed or where the Project is located? This is a private project and we are a GC.

Since the project is located in Georgia, and consequently Georgia lien waivers are required, the top of the waiver should indicate the State of Georgia, and the County where the improvement is located. Furthermore, the statute that provides the form in which waivers need to be in (OCGA §44-14-366), specifically provides the State of Georgia, while leaving the county portion blank. This is yet another indication that the Georgia county should be provided on the waiver. For further resources, see:

Since the Project is located in Georgia, and the lien waiver pertains to a liens that could be filed relating to the Project, the waiver should list the State of Georgia and the county in wich the Project is located.
