I was fooled into doing a lot of work for a Contractor who I thought was my personal friend. He called me in off of my own projects to assist in some large loss claim work in Panama City Beach after Hurricane Michael. I asked repeatedly for a contract or something in writing however he was constantly gone and would never respond. I continued to do what I thought was the right thing at the moment and ultimately i have ended up completing his project and making him very wealthy. He has since been blowing all of the money and refuses to pay me. This is in excess of 1.5 million dollars worth of equipment rental, materials and labor provided on the Bay County Correctional Facility. I am desperately trying to figure out how to not only get paid but to expose his company for what it actually is. A rip off scam for insurance companies during catastrophic events such as hurricanes etc. Any advice is greatly appreciated in advance. ...Read More

I am a NC sub-contractor and I need to file a lien on funds. I have waited patiently for 90 days to be paid on the work from our GC. We have this 'lien on funds' in NC that freezes payment in the hands of who has it. It's different than a lien on property. A copy of it goes to the CG and the property owner. This locks down any future payment until the owner pays us since the GC isn't paying us timely. Unlike a regular lien on a property, nothing gets filed or recorded. It's just a series of certified letters to the GC and the Owner. How does this hold any weight without it being filed or recorded like a 'lien on property' is....Read More

We supply solids removal equipment to Contractors and Subcontractors for large municipal and private water projects. Our Agreements include startup and commissioning services as part of the agreement. During the construction of the facility, we may deliver the physical equipment in March and not be back to perform startup/commissioning until November, eight months after the equipment was delivered. In states that require notices and lien documents be filed within an allotted number of days after delivery how does the delay of services play into the timing. Example: we delivered equipment to a facility in KY in October of 2018. The Contractor held 5% retainage. In June 2019, we performed the startup, commissioned the equipment, and invoiced for the startup. We received notice in July that the Contractor filed for bankruptcy. ...Read More
