Roof repair completed August 6, 2019. Insurance paid 10K and I am billed $9K more. Insurance refuses to disburse balance due. Contractor sent Intent letter to Lien Mobile Home for unpaid bill. Per FL Statute 713, I can withhold monies until Contractor ascertains all people participating on the project have been paid. I sent Certified letter to Contractor asking for a list of subcontractors, sub-subcontractors, suppliers and material-man about 2 months ago. No reply. Yesterday, I sent new Certified letter asking for Contractor's Final Payment Affidavit before I pay final bill to make sure who remain (if any) without pay. Still have not heard from Contractor. Looks to me Contractor wants to file lien without giving me this info. How can I protect myself and properly pay outstanding bill without knowing whom (subcontractors, sub-subcontractors, etc) participated in project, the pay they deserve and if they are paid in full? I need to stop Contractor on its tracks (I am under the impression they probably want to charge me interest charges, like if I am a money printing machine and that's an act of bad faith) and stop further modifications to the filed lien if it goes through. I have a mechanic's lien that has been assigned to me and notarized but it still shows up at the recorder of deed's under the name of the contractor who did the work. Contractor closed up shop and left a lot of homeowners and subcontractors (us) high and dry. I field liens on all properties with unpaid balances. Several of the homeowners contacted us and made payments, a few did not. How much would it cost to enforce a lien as some of the balances ate below $2000. Collectively it may be worth the effort but what is the cost for EACH enforcement? It's been at least 6 months and I only have 1 year to enforce. Thank you....Read More

I am a painting contractor owed by a builder who sold the house we painted. Can I lien the new owner for money the builder has not paid me. Also I did not originally file a preliminary notice on the job. Can I file notice for the recent work we did only, since that is what he owes me for. He paid me up until the end of the job, which was a huge house that sold for $26,000,000.00. He owes me about $24,000.00 for Epoxy coating on a 10 car garage which we just did a couple weeks ago. He also owes an additional $22,000.00 from the original work but I stupidly signed a unconditional progress draw release on that amount. The more recent work I only signed a conditional release.
