We have a nonperforming sub, whose contract was supplemented by another. They provided a preliminary notice, but have no right to their full contract due to change orders written for supplementing their work. We as the General are due change orders and retention on the contract with owner yet, so are questioning if we should be asking the owner to file the notice of completion on the job yet or not. We have contract with a customer that we installed a new HVAC system in his home and after installation (before we had completed job to 100%) he expressed his 3 day right to cancel after the 3 days. He has demanded for us to come and remove the equipment under the condition that he not be at the location. We had refused this as we will not go to his home with out him there. The initial notice was sent via certified mail to the previous address of the homeowner and was returned because well, he didnt own that property anymore and wasnt living there. Washington requires service by certified mail for initial notices but it was then resent by regular mail. Would this still be considered a valid service of the initial notice?...Read More

Our existing process has been to update the primary contract pre-lien with the subsequent change orders. This however does not favor the sub-contractor, as I don’t want the lien dates to be continually reset for relatively small change orders. I would prefer, if the change orders are over $1000, to submit pre-liens on those and let them stand on their own. I have an example of a primary contract order of approximately $150k. The primary job is now complete and I want the lien clock to start, so I will press for final payment within 60-days, on the outside. We may be getting a change order for around $1500, which I would like to treat separately and not reset the clock on the main job. Is this an acceptable approach and fall within the lien rights of sub-contractors?...Read More
