On Aug 19 2019 I started re-designing a deck for Nancy Thompson. There when many delays with wood choice and deck stain color. 2 weeks into project the weather became a factor as it rained often. I continued to work on her deck through Dec 8th 2019. The only Items left to do was sand, stain deck and a few trim pieces. We did an installation at our customer's property and they claim that we did damage to their building. They are withholding 41K from us because of their "claim". After numerous attempts and over half a year of trying to get any proof to back up what they are accusing us of, they have not provided and other info. Recently, they contacted us for service and gave us an ultimatum of paying half of the outstanding balance as a final settlement, or they would pursue litigation. We believe we did not do anything to that building so we are not giving up 20K just like that. They have many other mechanic liens under their company so we believe their claim that we did damage is just them trying to get out of paying or just getting a cheaper deal. I recently finished building a custom home. I had a contract with a GC but did not have any contracts with any subs, just bids. None of the subs filed a pre-lien. I paid all the subs directly, the GC did not. The electrician gave me a bid of $27K to provide all the materials/labor to rough and trim out the house except the actual light fixtures. I actually performed 30-40% of the labor and purchased about 40% of the materials for rough in. I paid the electrician $16K in cash at the end of rough in. At trim out I performed 90% of the labor and provide 98% of the materials. My electrician sent me a bill for $8500. I told him this was ridiculous and I wasn't paying him 24.5K for a job where I did a lot of the labor myself and purchased most of the materials he was supposed to. I told him I would give him an additional $1K cash but that was it. He threatened to sue and file a lien on my property. The completion of the project is over 90 days, my COO is over 60 (fighting with the city on a drainage issue held it up) and my recorded notice of completion is over 30 days old. I am the homeowner who signed a contract for someone to remodel my home after it was damaged. contract stated all materials and labor were included in the quote.Only way they can change is if it was in written request. We are at the end of four months on a two month job. Contractor is trying to force me to sign a new contract for my insurance to pay more and for me to pay more. I hired a contractor to remodel three bathrooms. I refused to pay him the full amount because of shoddy work (eg one of his subs damaged a wall and it was not properly repaired incorrect work (he used the wrong color grout in one bathroom, did patching jobsand textured walls that had been virtually smooth, etc. We discussed a compromise but did not reach an agreement, and he kept making up new charges for things we never agreed to The unpaid balance is $3862, but he placed a lien for $10280. A customer of mine asked to use my tractor for some light work on his property. He cracked the boom and broke the hydrolic arm. Is he liable for the whole repair? I own a septic and plumbing company since 2006 but have been going through a divorce since 2009. I informed the property owner my licence was not active I was there as a subcontactor. The home owner was responsible for all permits. The work I did there on his property took over 6 months to complete. I also have a study job at the home depot. I would leave my tractor there and come up on the weekends to do work the homeowner requested. I put in 2 septic systems with no problems. I got a call from his "Forman" asking if he had permission to move some dirt. I said it was ok . Later on that day I got a call from the forman telling me that when he was driving it to put air in the tire the back arm was swingging and ready to fall off. The hour meter shows the tractor was running for three hours. I spoke with a equiptment mechanic and farm equiptment expert on justanswer.Com who told me that the only way the damage to the boom could of happend was somebody used the tractor and tried to carry way beyond the load compacity which was 11,000 pounds. The work I did there didnt exceed 800lb load. The home owner had large stone bathtubs on his property. I believe they tried to move them with my tractor. I left my equiptment there because the homeowner had installed a security system and cameras all over his property to watch his employees. He claimed the cameras were not on that day.
