2 Mechanic's liens were filed on my property. The law suit was filed, but I was not served. I learned this 6 months later and just learned of the lawsuit this year in 2020. The liens are improper.
There is a procedure for removing improper liens for which a lawsuit has been filed within the context of the lawsuit itself. The procedure is referred to as a Lambert Motion which is named after the case law that established this procedure for removing liens. You would need to file a Lambert Motion in the lawsuit arguing that the liens should be released because they are improper. To successfully do so though, you will need to demonstrate the procedural or substantive grounds on which the liens are improper.
