Hi - I just tried to submit a decently long question and got an error message. I'm not sure if it went through or not, so I'll try to summarize briefly. A customer is trying to prematurely exit a signed construction contract on a residential house. Between the signing of the contract and now, I had started some preliminary work like dirt work, tree removal, permitting, door and window schedule, etc. The customers' original bank returned a very low appraisal. The second bank of their choosing (Iberiabank) requires a very invasive process for the builder (me) to be on their approved list. I balked at this requests but told the customer I was willing to work with the bank if they felt strongly about using them, but recommended another bank in town who I thought would be better. At this point the customer emailed that he would like to put the project on hold and asked that I send him an invoice for the work done to this point. After receiving my invoice, he said he would not pay until her received detailed subcontractor invoices (not a clause in our contract), and that due to my unwillingness to work with Iberiabank (not true) that he was cancelling the contract. I would like to know the best way to go about 1) getting paid on my invoice I have submitted (~$6,000) and 2) seeking damages for lost opportunity and lost profit (~$100,000)....Read More

I'm a general contractor. We completed construction on 10/6/2021. The customer complained about issues and held payment until resolved. We have documented all resolutions and customer has still yet to pay the amount owed as of 3/21/2022. We are now wanting to file a lien for the remaining balance. We may have missed some of the deadlines because we were working on resolutions in good faith that the customer would pay us once resolved, but we would like to take measures to try and get paid and formally get the process of a lien going. are we out of luck or should we attempt to file? At the very least, we'd like the homeowner to see that we are serious by receiving the notices that we've filed because perhaps that will initiate a payment from them. ...Read More

I have signed a contract with a roofer to replace my roof, he told me it's a non-binding and he can not negotiate with insurance without a signed contract, so he insisted, and I signed. We agreed to discuss the final amount after his negotiation with my insurance, After that hebut he never get back to me , but he sent another final contract with new numbers, which I never signed or accepted. All of a sudden, he came to my home with 10 roofers and said as per the appointment, they are scheduled to replace my roof. The appointment was never agreed or accepted , because I did not agree with the final contract he sent me after negotiating with insurance. Now he sent me demand letter, what are my options? I started a porch remodel. I had a few other jobs going on at same time. I wasn't on the porch job as much as I should have been. I was trying to contact owner to tell him we needed to remove block foundation and start over. He wouldn't stop by so I could discuss this with him. So I waited for him to get in contact with me. If a unlicensed GC hired you as a laborer to install the drywall in a slow building 3500 sqft custom home he was hired to complete. He agreed to pay 50% of the originally estimated contract of $16000 in quarter payments as the work progressed accordingly. The job has taken over a month to complete and with only 2 closets left will be done tomorrow. I have only been paid a total of $900 so far and that was 3 weeks ago. Yesterday I was told that the homeowner only owes another $2500 for the job and that will be split between the 2 of us which will ultimately end up a payment of $1250 and a total payment of $2150 for what I've counted out to be 64 days of work and just under $40 a day. This job is 3 hours outside phoenix (home) and granted the GC allowed me to stay at his house for the duration of the job I still paid all my own travel expenses and used my truck to and from the job site and etc... What should I do at this point? ​ Should I approach the homeowner directly even though I'm not the one contracted got the job? Do I start the process on a mechanics lien against the homeowner now to ensure I meet the deadline to file? The state of Arizona doesn't require a preliminary notice be sent, but it feels wrong to go to such an extreme without even talking to him first... Or do I file suit against the one who brought me in on the job ? He doesn't have a contractors license or any certifications so I'm not even sure I can do that, not to mention the state of Arizona considers any job taken by an unlicensed contractor that pays over $700 a felony so if I file a mechanics lien claiming to be unpaid subcontractor that would leave me open to felony charges and in worst case scenario could lead to possible prison time.
