For one of my clients, we do countertops and cabinets for her, well before sending anything over to install, we send a drawing to confirm. She had confirmed the drawing and she's added more stuff to it during installation. On top of that, she saying we did a shitty job, and now she's asking for a FULL refund after a whole show.. I believe the mistake on both sides but still for a full refund and wants to take us to court . Can I put a lien on the house?...Read More

I was a GC on a project with a real estate agent in Wyoming. On that project I am owed around $40,000. I also was involved with this person on a fix and flip project as well. My recently deceased sister and her husband were partners with me, and we put approx. 35k each into the project and this person was part was to finance the purchase and cover utilities. after a failed sales attempt they took it off the market rented it out and said to bad, your out your investment. I also rent the current residence from the same person today i was told if i didnt sign a lien waiver they would start eviction proceedings Please advise...Read More

I’m a general contractor who took on the role of a subcontractor with the homeowner acting as general contractor, I entered into contract to frame, side, and roof a home with a deposit up front and a draw upon completion of each phase. Upon completion of framing the home owner decided to not pay and trespassed me from his property, unprovoked and without reason. Now he is coming after me legally, he tried the the state license board and that didn’t pan out for him so he’s now retained a company called DCI and in my eyes he owes me remainder on contract but at minimum the $10,000 due to me upon completion of the framing. I had a drainage system put in my basement. And I financed the job. However, the finance company released the payment to the contractor before I signed any type of paperwork stating the job had been completed to my satisfaction. All they did was leave a voicemail saying they were going to release the money and released it before I heard the message. I am still getting some water that the contractor is working on. My concern is the clock on my 6 months 0% financing has started before the job is truly complete. We had a dispute with a contractor years ago about work done to our home. His last date of work on our home was Dec 2018. This year we listed our home for sale and miraculously, the contractor somehow feels he has a right to collect on work he never finished. He falsified and filed a Mechanics Lien this year, overshooting the deadline by several years. We deposited money with the courts to sell our home. Now that the house is sold, we wanted to take him to court to prove the lien willfully exaggerated and have it declared void/get it vacated. His attorney/debt collector wants to settle for less than what they claim we owe, however, they want us to pay money directly to them. I don't want to end up worse off and since the court system has our money and are holding those funds, how do I get them back? How do we ensure no shenanigans?...Read More

We provide a quote for the additional work but they will not approve the price, they demand the work to be done and only after that will they discuss price. There is a contract clause that seems to give them the right to demand we continue working. I'm a general contractor hired by an owner and I have multiple subcontractors with signed agreements for the project. The client has not paid for over 2 months and lien notices are going out. The owner has been requesting signed lien waivers, material receipts and proof of construction expenses etc. none of that is part of our (Owner / GC) agreement.
