Our company performed 4 COVID cleanings on 4 boost mobile properties, all operated by a single person. We have contacted him many times by phone, both leaving messages and speaking with him personally. We have sent multiple emails, both directly to him, as well as other emails that he has provided (supposedly the owner, but we have received no response.) At this time we believe that he has no intention of remitting payment, and perhaps never did. What is the process (if any) that we would go through to file a criminal theft of services report? The total amount of his bill is over $2,000, which I believe would constitute a class A misdemeanor....Read More

I wrote a check "payment in full" for a dispute with my general contractor on the very top of the check and on the bottom in the memo line. The contractor scratched off the language - payment in full in the memo section but left the language on the top of the check. Can I make a case that it was an accord and satisfaction with the court because the language "payment in full" was still evidenced on the face of the check?...Read More

A former customer of mine owes me for three different invoices for work that was completed at his place of business .The former customer & his family are immigrant from another country. They do not understand a lot of stuff that we just assume are simple things you should already know. Like what a lien is. This is the kind of stuff I used to help them with. Now that we have had a falling out, they have cut all contact with me. I know where they live, cause I also worked for them as a handyman at there personal home. They do not trust a lot of people because of people taking advantage of them. This is where the falling out happened. Two days after the hurricane hit us in south Louisiana all the ****Explicate Language**** started showing up to feed on the weak. Anyways long story short I tried like hell to keep the "wolfs" at bay but one got to them witch in turn hurt my company. now to the question at hand, could this be seen to the justice system as a threat or some kind of intimidation act on them? I'm not trying to achieve such a thing, I still find them to be good people and want them to know that this is going to hurt their business. Hello, I am a general contractor in California and I am in the process of entering into a contract with a customer for a tenant improvement project. The tenant has full plans and city building permit issued which wouldn't be issued without the property owners signature of allowance in our city. What do I do as far as protecting myself if the tenant decides not to pay me? I'm a Hunter Douglas window fashion representative. I've installed the 16 shades that were custom ordered and customer refused to pay balance at time of installation. She contacted me a week later complaining shades where fraying on some of custom shade edges. I worked with Holli Gabler for 4 months to offer her replacement solutions at no additional cost to her. An ex-vendor provided security services to our property for 2-3 years. In March or April of this year, they came to the conclusion they billed us incorrectly for virtually all of 2020 and sent us a bill for $8k to make up for their apparent error. After requesting proof of the incorrect billing to support their case – they never provided this. Furthermore, we asked for a copy of the contract that says they have the right to do this and can place a lien on our property for non-payment. To no surprise, they have not produced a contract. I was hired by a guy I called my friend. He was hired by a disaster restoration company. He wouldnt tell me what company, or which insurance company. I performed services and provided materials for plumbing repairs. When I gave him the invoice he began to question everything on it. He also became verbally abusive. He told me he required all of my receipts for materials. I do have mark up on my parts. I also added profit and overhead to the bill. I can’t seem to get him to call me back. We are a subcontractor and our GC's accounting team stated 2 weeks ago 8/20/21 that they received payment for our June Final retainage payment. We gave them the warranty for the work and have the lien release ready to go but their Project Manager will not release the funds to us because they are waiting for "the owner to get the transformer set". Can they hold our payment for something not related to our work on the site in Florida? Original payment for final retainage was sent back in June (20th-25th). It's only $5,700 but they keep dragging this out and going in circles....Read More
