I am a property owner. Our contractor walked away from our shop project, after he was paid in full and did not complete the project because he burned our house down. We filed a complaint for mediation with the CSLB which was delayed due to COVID and the contractor's license being suspended for a time. We were finally issued a formal citation which we forwarded to The Guardian Group representing the surety bond company. They agreed to the total damages in the citation of $15,196; however they took a credit of $9,200 claiming this amount was owed to the contract. Unfortunately, we had 4 contracts with this contractor. All 4 were paid in full. They are creating an over payment of $9,200 by taking the credit against the damages. The problem is that we are running out of time on the bond claim deadline which is 12/30/2021. Is there any way to get the deadline extended? Everything took much longer than normal due to COVID orders. Plus, we lost time while the contractor's license was suspended. the CSLB didn't work the citation while his license was suspended. Hello, There was damage done to my home. A construction company had me sign a contract that allowed him to accept money directly from the Mortgage company. The company took 2 years to due the project and its still not done. In the middle of construction the Mortgage company issued a check with my name and the Contractor's name on it. The Contractor died. His company filed for Chapter 11. What are my rights to get that check endorsed by the Bankruptcy Trustee and given to me to finish my house? It is my understanding that if there is a Mechanic's lien against the property that the money is NOT part of the bankruptcy estate and that the Trustee can simply endorse the check on behalf of the Construction company. What if there is not a mechanic's lien on the property? Does the check become part of the chapter 11 filing, and my insurance money is just mixed in with all of the other Chapter 11 unsecured creditors? Can I at least be given Priority status as a creditor? This is taking place in NJ Bankruptcy Court under chapter 11 . Can I file against his bond company? I read that I might be able to give a 30 day notice to the Construction company to force them to file a mechanics lien, is that true? Any information would be very helpful. ...Read More

Contracted a company to build a sunroom in April of this year. The project has not been completed as of November 20, 2021. I cannot get a straight answer for the owner of the company. It varies from waiting on supplies, and workforce. The answer recently has been its' sitting on a "Ship somewhere on the ocean". To make matters worse they have over $14,000.00 which is half of the cost of the project. Additionally, the building permit has expired, which will be need to refiled and paid again. I've called and emailed with no response; only once did I have the opportunity to one of the owners. It didn't help, he just kept saying six months for windows and vinyl. We are way past six months at this point. Help. What type of formal letter can I write, requesting a completion date. Where do I start....Read More

I'm a subcontractor working a large commercial project and didn't get paid for work completed so I stop production & sent them a notice and then .. I put a lien on project but I was told that they are bonding the project because the owner ask them too . What can I do to protect myself and to recover my money invested in that project ? Also, the company that I have the contract with has a few lawsuits for doing the same thing in other projects ( not paying there subs) and they are now going out of business because of all this issues. I am a steel subcontractor working on a public job in Alabama. I have two separate "contracts" for this job. A purchase order for the steel materials and a subcontract for the steel field erection services. The GC has had all kinds of problems on this job and is likely facing some liquidated damages. As such they are looking for every possible pocket to back charge including mine. No matter how false the claims, they are using a "throw it against the wall" approach and see what sticks. Yesterday the informed me they are holding payment until they can confirm or argue many of their so called "back charges" for delays. So, I would like to file liens to protect myself. (a) do I need to file separate liens for the PO and the subcontract? I would think I would? (b) I currently have billing that is 20 days past due and more coming due in about 15 days.
