I own a piece of land in Virginia, and allowed my then Brother-In-Law to place approximately 100 pallets of building materials (brick, block, etc) on that land. Now, 4+ years (and a divorce) later, the building materials are still there - and I want to sell the land. I've got a buyer and an offer to purchase the land, but only if the building materials are removed. What's the best way to give him notice that I want the building materials gone? (And if he ultimately refuses to respond - or won't remove them can I assume that they're abandoned and dispose of them myself?) ...Read More

Hello! We worked on a project Dairy central Phase 2 in Virginia. Last delivery was 10/07/2021, we are not paid for deliveries from 05/20/2021, 09/27/2021 and 10/07/2021. On 12/02/2021 we filed a Lien on the property, last day covered according to 150 rule is 05/10/2021 so we should be covered. We also sent Preliminary notice to client and owner on 09/30/2021. Notice of intent to Lien to client on 10/25/2021 Post work Notice on 11/19/2021 to owners and client (we were late if deadline is 30 days after last delivery) Lien filed 12/02/2021 Today we find out, that probably our project address is not exactly correct, as Dairy central project is combined from few phases, and we worked on Phase 2. To the Lien we added 946 Grady street Ave, Charlottesville, VA 22903, but looks like Phase 2 building is located at 400 10th Street NW, Charlottesville, VA 220903. According to 946 Grady street Ave address Levelset added owner name - Dairy Central Phase 1 LLC, but looks like we should change this as well to Dairy Central Phase 2 LLC. On other documents we saw Stony Point Design Build as owner as well, so we listed two companies as owners on the Lien. If Lien deadline is 90 days from last delivery we should have time till deadline 01/28/2022 right? 2. How should we amend other documents - preliminary notice, Notice of intent to Lien and Post work notice. If these still will be valid if we will change and send now? 3. A Mechanics Lien was placed on my condominium unit (one of 38 in the condo community) by a company who had erected/installed a telecommunications tower on city property adjacent to the condo community in which I live. My unit was arbitrarily cited for the lien. I never received any notice of the lien until a letter arrived on 9/30/2020 stating the Mechanics Lien had been released approximately five to six weeks after having been filed. I called the person from the Prime Contractor who had sent the release and his only explanation was "They had to have a physical address as they could not use just a street name" despite the fact that no work had been done on the private property of either the condo community nor mine own. How could my specific unit be "selected" for the lien to be filed against, particularly without my knowledge. It is my understanding that this lien and it's subsequent release will stay on my property record for at least seven years. I'm not a lawyer, but somehow this doesn't seem legal. Do I have a legal leg upon which to stand were I incline to pursue any course of restitution?...Read More

We just started on a project yesterday but the GC handled the contracts a little different than most. They actually issued us 7 contracts for this one project. One project per scope. Such as a contract for framing, a contract for drywall, etc. Do I need to send a prelim notice for each contract, or just send one and list the total amount of all contracts?...Read More
