On the contract the contractor was supposed to put in an 8x8 and a 3x3 concrete slab. The contractor put in a 6x6 slab and when questioned why by the owner, the contractor said well that’s what you’re getting. The contractor was given beforehand $12,000 dollars good faith money, so the contractor wouldn’t have to take money out of his account to pay for all the materials needed for the project. The project was never completed. So after 90 days the owner sent a letter firing the contractor because he never finished the job. Two weeks after the contractor filed a mechanics lien on the owners resident, stating that the owner owed the contractor $2,000 for the slab of concrete that was not the correct size per contract. If you paid an unlicensed contractor good faith money, so all the materials are paid, so the contractor die have to use his money to pay for materials. On the contract the contract was to put in 3x3 and an 8x8 slab of cement, but the contractor for some reason put in a 6x6 slab and when asked why contractor told the owner that’s all you’re getting. Then the contractor walk out without finishing the project. After 90 days the owner sent a letter firing the contractor and hired a new one to finish the project. I just found out that our client that we supplied materials to (Tile company) hires subcontractors to do the installs. This means that our client does not need a contractors license. So I believe this makes us a supplier to a supplier. Correct? if that is the case can we file liens in VA and DC if we are a supplier to a supplier?...Read More

We are using LevelSet to file a lien on a job that we performed in Virginia. Thursday 4/23 will be exactly 2 weeks from day 1 of install and Friday 4/24 will be 2 weeks from final date of service. We are an Electrical contractor and have not been paid for completed work. We filed a mechanics lien, and they bonded it off... I guess, if that is the right word. We received mail that they submitted the bond to the court in VA beach to have the lien removed. Still haven't been paid. I need help in the next step. Do I get in touch with the bond company? I am a supplier providing good to a project in VA. The customer who is the GC, required a payment application be signed before agreeing to make the final payment. The payment app included a waiver as part of the language. We signed the payment application, but stamped it with the words "Do Not Record. This is a Copy." Does that stamp have any impact on whether the waiver is still valid? In other words, can I still file a lien ?...Read More

We are victims of the David James Homes fraud in Virginia. All our payments were to DJH we had no dealings with the subcontractors, did not hire them or sign contracts with them and have no idea who most of them are. We were never owing to DJH at any time in our contract with DJH and are, in fact, owed $42,000 by DJH for work we paid for not supplied. A subcontractor has put a lien against our property in the amount of $3,800. It is now past the 6 months deadline they have to enforce it. Additionally, it is for work we already paid DJH for (DJH had a very weird PREpay draw schedule, so we gave the money for counters to DJH 3 months before they were installed, DJH just never gave the money to the subs). Merle Heckman filed bankruptcy last fall with DJH. The case is ongoing. Because the 6 months has passed, can I petition my local county court to remove the lien or do I need to wait until some specified time after the DJH bankruptcy case closes? The "automatic stay" wording regarding bankruptcy was confusing and I don't want to petition to have a lien removed before the window for enforcement has closed....Read More

2014 customer contacts me through Home Advisor, needing concrete porch & steps. I do job, he pays, no problem. Fast forward 6 years, he plagues me with voicemails that he has cracking and needs me to take a look, and asks which form of payment do I want, cash or check? I finally get there, as this job is 2 hours from my area, on large Lake. We discuss issue and he agrees to my price of $10,800.00 for demo of a portion of concrete and repour. I do job, renting jack hammer, other equipment, buy concrete, and pay my guys, job turns out good. My findings are that the cause of this isse is his place was built on filldirt, and everything is sinking. Job is complete, I knock on door to submit bill, NO Answer! I leave bill in door, 2 weeks later ... No Payment. I stop up there yesterday, lights go out when I pull in, I pound on door, he answers with an attitude... saying he's not paying but $3,000.00! He doesn't feel he should pay, I say, why should I pay for your house being built on fill, everything is now settling after 20 years. He says "I wanted the job done"!
