The Memorandum of Lien, assuming it was correctly (and timely!) filed and notice was provided to the owner, is generally valid for 6 months, after which it will expire. A lawsuit to enforce must be filed within this time in the Circuit Court to move to the next stage, which is foreclosure of the property on account of the mechanic's lien. But, be aware that payment is a defense in Virginia, so if the owner already paid the builder/gc for your scope of work, your lien can be defended on the basis of that payment, even though it was never fully received by you.
