I had a contractor come to my home and ask to view my roof. He helped me start the claim process with my Insurance company. I did not sign any contract only thing I signed was that the contractor did the inspection and roof needed replacing. I did some research on The contractor and found out he wasn't very reputable. So I wanted to get a 2nd Opinion on my roof. I told this to the contractor and I was told by him that he can put a Lien on my home since Insurance has contracted him. I called my insurance and they said his company isn't contracted on anything. My question is. Can he put a line on my home even tho not work was preformed on my property and I didn't sign anything saying he can work on my property....Read More

We are a small business that does fabrication and installation of custom countertops. We create estimates when bidding projects and ask customers to sign and email them back. However, many customers refuse to sign and only email back stating "Approved" in the email body. In case any issues arise and we don't receive payment will the email suffice to take to court to file a lien? Please advise....Read More

I represent a subcontractor who wants to be paid his final draw of $25,000. I received an email from the owner saying she doesn't have to pay my client because the GC was supposedly paid in full but has abandoned the project leaving my client without the final payment of $25,000. The property owner says she will not pay as she has committed no fraud. We mailed the notice of intent as of July 28 and would like to proceed with filing the lien. ...Read More

We filed a mechanical lean and a couple of days later we received a call from a contractor that was taking over the project saying that they will sue JAG construction and getting a check for the electrician, plumbers, etc that JAG didn’t pay. We have a client that we were getting ready to send the 3rd month notice out to as August 15th would be the deadline to send. We received an email yesterday saying that the check was ready ( less 10%) but in order to pick up we would need to sign the contract and a conditional waiver and release on progress payment. The job ( at least our portion) has been completed since May- the contract that they are just sending over agrees to 10% retainage to be payable 30 days after completion or up contractor being paid from owner. If we signed this contract now- what would our collection rights be on the remaining 10% of the contract? ...Read More

I am the owner, I payed 90% of the job and retained 10% to be sure the contract completed the job but they don’t what to finish the job and they walked away abs not answering call or emails (I know by law I can retain the 10% per 30 days abs I am still on thta window ). Now a subcontractor that I did not do any business with is calling telling the contractor has not pay any to them which is about 40% or the total cost . They will file a lien against the property. What can o do to protect myself if I has being paying on time . The 10!% pending does not cover the subcontractor bill and for material, I actually paid the 50% in advance for material about 3 months ago The contractor is being totally dishonest in this case . ...Read More

What are my rights after 07/09/2021. Received request for payoff amount to be good through June 16, 2021 from title company, then they asked me to extend to the 28th of June. When we called on the 28th of June the title company stated that everything was still moving forward and they would request a revised payoff as soon as they can nail down a closing date, but confirmed that it would be in July as the buyer and Lenders were ready and waiting.  I also attempted to reach out to the sellers in late June/early July, but could not get through.  Now I'm in receipt of a letter from an attorney representing the seller asking me to sign a release for only $10.00.
