I was hired to install a sink. The sink was installed but during installation the countertop was damaged. The damage could be repaired and I purchased the repair kits and started the work. The original work was completed. All was fine until customer was asked to make a partial payment. At that point she said she was unhappy with the incomplete repair and wanted to file a claim with my insurance. She was given insurance info. Our written and signed contract states that if any damage occurs that my company will either make repairs or hire a 3rd party to complete the repair. Also, given the event that customer chooses to hire their own 3rd party, they would be responsible for payment to that 3rd party and would relinquish me of all liability. It should also be noted that she did tell me that she received a quote from a 3rd party to have her entire countertop replaced. I believe that she crossed the line when she expressed that she had formally received a quote and requested my insurance info. A claim has also been filed with my insurance, that was done by me. Given all that has transpired, is she still responsible for the original sink install, which is completed and in perfect working order? Thank you for your time and assistance....Read More

Hello, I am a contractor who was hired to demolition and remodel the interior of a house. While working on this house I was told by the owner that they intend on using it as a miniature version of the store that they also own next door to this house. This house and store are located on a property that I am told is 73 acres - all owned by the same person. I am trying to file a mechanics lien against the property owner because they refuse to pay for the remodel we completed inside of that house. However I don't know whether to classify the property as RESIDENTIAL or COMMERCIAL because although it is a House I was TOLD it would be used as a "mini store" to sell the some of the same items that they sell in their larger, actual store next door. What should I classify this property and will it complicate my mechanics lien?...Read More

Filed an intent lean on a job in Texas though here, trying to figure out if it a residential job or not. Its a development for townhomes, not sure if it's subdivided or not, it has street names. My issue is that I learned now that I'm apparently supposed to send a monthly notice, and I'm past the date if it is residential. Also, had to send invoices in once to the former project manager, then he quit, and then I had to turn in the invoices again to new guy a month later, so does the clock start over?...Read More

I am a steel fabrication subcontractor. I haven't filed any types of lien documents or notices. I sent my first invoice 3 months ago for $10K for detailing/blueprint cost. I have not received payment. I completed the job and sent my final invoice for $160K last month. I am scheduled to deliver steel to the jobsite soon. I fear that if I deliver the steel I lose all leverage. They have not paid me for 3 months on $10K. Who knows how long they'll wait on $160K. I would be the General Contractor on a job in Texas. The beginning estimate on the job was $4,000. After working on the job for around 3 months a lot of extra work had been added on to the job. The $4,000 was paid with draws throughout the job. 3 days before the conclusion of the job the customer left town and I haven't seen him since. The final invoice of $3572 was sending to the customer. At this point he started claiming that we had stole some ceramic tile. We haven't heard a singke complaint from the Customer. Matter of fact he did nothing but praise the workmanship in the job. He has stated that things like tearing down a wall that he shoukdnt have to pay for the electrical because the switch was in the wall and it ran to the ceiling fan and that was on me that the ceiling fan stoped working when I tore a wall down. Basically he has came up with so many different reasons not to pay that I can't keep up with it all. The actual work performed ckukdbhsve come out to over $8,000 but I cut him a good deal and he still thinks he shouldn't pay. Should I go ahead and file for the $8,000 estimate or just take what I can get and stick to the $3572? I have already sent a letter of intent...Read More

Roofing company came out to assess my roof for repairs back in 2020. The insurance adjuster also came out. The roofing and restoration company were responsible for replacing my roof and a window that was leaking. They finally got around to replacing the roof, but never did the work or came out to repair the leaking window. It's 2022 and my window is still not fixed, and they are requesting that I send them the last portion of the money that the insurance company sent me to have the window fixed. They have not sent me a copy of the contract, or I don't have any written notices that the company has claimed to have sent me.
