Hello, we spoke with another plumbing company the other day, and they stated that they charge the customer for the cost of the lien and admin fee on top of what the customer owes them when they file a lien. They said it is completely legal for us to do so. Just want to make sure that is correct
You really should retain a construction attorney to evaluate your legal situation and to provide advice. What is appropriate depends on your circumstances, and the nature of the project (commercial or residential), and other factors.
Filing a mechanic's lien on a person's homestead property is risky, as doing so could violate the Texas Fraudulent Lien Act, and the filer could face statutory damages of $10,000, or actual damages, whichever is greater, plus attorney's fees.
Good luck.
