Can a Lien be filed when there is work performed for a project but not necessarily on site of the project?

Texas

Can you only file a lien on work that was performed on site? Also, are there options available when you perform work for the project, as opposed on the project? Thank you, Courtnie

You can file a lien for work you did away from the project site. Texas law gives anyone who specifically fabricates material, even if that material is not delivered, the right to file a mechanics lien.

However, without more information, I couldn't tell you whether the work you did would fall under this rule. What I can tell you, is that even if you are not be entitled to a mechanics lien, you should send your required notices to the GC and the property owner. The notices are a good way to get the attention of both parties and can sometimes result in payment. Notices are also a perfect opportunity to demand payment from the parties. There's no reason not to include a demand with your notice. I recommend doing this just about every time you are not paid for the work you did on a project.

If you feel you may need an attorney and you want to discuss your issue in more detail, feel free to call us at Murphy Legal. We work all across Texas. Our phone number is (979) 690-0800.

Good luck!
