Long story short, like many construction firms, my firm has found itself participating in another arbitration case. We are representing ourselves pro se. The owner of my firm has been out, and hospitalized, due to serious medical issues. I am participating, but has no executive agency to make decisions. Because of the above stipulated issues, we have requested an extension of the process. This would be are 2nd extension, again due to the above. However, counsel for the opposing party (the claimant) has not concurred with this extension. I know that we need to get our lawyer involved, but in the interim, what are our options? Because of the extenuating circumstances what can be done on our end to extend this process? Thank you! ...Read More

With 10% retainage being held on an electrical contract that will run through the entirety of the construction project (not completed partially through overall project, etc.) Should the approved percentage of a given pay app reflect the estimated completion of the work independently of the retainage, or take that 10% into consideration? Hired a guy to do a job, he did the job half assed.Then he used my business name and went out and got down payments from people one was for 2500 another for 2700 another for 3500 and sign a contract with these people. I have a plumber who is sending me an invoice for a service charge of 112$. We originally called the plumber told them our hot water heater had gone out no mention of a service quote was discussed. Within 40 min a plumber showed up, said "yes yo do need a hot water heater" I already had known this and that was the reason for the original call. The plumber did not have a hot water heater that day and told me it would be a couple days befor the work could be done. I had already found another plumber to do the job so told him no thankyou. No paperwork was ever signed and no payment was ever discussed. They are now invoiceing me for 112$ for something they never did. They did not quote a problem nor do any work. When I called regarding the invoice they told me they have a contract with a name scribbled which I never signed. They said if we dont pay they will recruit a 1.5% interest and put a mechanics lein on the house. What are my options?...Read More

I have been doing freelance work for a company. I have a full-time job, and I do freelance graphic design work on the side. I signed a new contract with a design company in October, 2019 to do work on an hourly basis, as needed. In their contract, it says this for payment. "FEE. For services to be rendered under this Agreement, Contractor shall be entitled to a fee according to the fee schedule set forth on Exhibit "A" which is attached hereto and made a part hereof. Said fee schedule may be amended from time to time by KSA&D sending notice of such amendment to Contractor at the address of Contractor set forth in Section 12 below and Contractor agrees to accept such amendment unless Contractor notifies KSA&D in writing within three (3) days after receipt of such amendment. All such amendments shall be effective immediately upon receipt unless otherwise noted by KSA&D or objected to by Contractor. Said fees shall be payable in monthly installments for services rendered in the prior month. Contractor shall submit invoices for all fees due under this Agreement." I started work the first week of November and sent an invoice in December. I then did more work in December and sent another invoice in January. I have not received any form of payment thus far and they keep saying they will send it, but they never do. It is now February, and they have not paid me for November yet. I haven't received one cent. My outstanding invoices for them total $1575.00 What can I do? Can I charge interest? How much? If I have to go to court, will I most likely win? I kept all correspondence from them and there have been no issues mentioned, so I know that my work is fine. I followed up repeatedly to make sure they had everything from me, and to get their input.
