I work for an HVAC company. I work with retrofit department and schedule my electricians to do high voltage connections. This is replacing old equipment. Not people with no heat!!!! Is MY position considered essential during covid-19 outbreak? I’m working but VERY uncomfortable.
OregonI placed a preliminary notice on a project when S&R Development was our customer. Through some changes, our customer changed from S&R Development to the GC on the project. Do I need to resend new Preliminary notices to show the correct relationship?
OregonIn the state of Oregon, as of 1/1/20, any retainage is required to be held in interest bearing escrow accounts. There is also a section that states that certain alternatives may be used, so the contract can "give" them to the agency in lieu of cash, so then the originally retained cash gets paid out.
Do you know how the actual logistics of this process works?
OregonIs House Bill 2415 in Oregon, which went into affect Jan. 1 2020 still related to PUBLIC work and not Private? If I look up OR retention information on Levelset, it states that there is no escrow account requirement for Private construction. An Owner we are contracted with states it is for Private construction as well.

OregonI am a lender on a project that is in the permitting stage. project manager has talked with general contractor about building the apartment project. general contractor filed a lien. general contractor has no contract for the building. Claims are based on "management" and "bidding work". How can a lien be filed without a contract on a commercial project (multi-floor apartment project).

I am in Oregon. I see that in Oregon, contractors or subs MUST send "right to lien" notice within 5 or 8 days of stariting/furnishing work. What happens when a contractor has been working for 6 months on a project and then send the notice of right to lien with a service start date which is 6 months back?
Can he/she still file lien for all costs that dates back 8 months from the preliminary "right to lien" notice date?
OregonWe live in Oregon. In 2018 we had windows installed. Today (1.12.20), we noticed that the inside trim is noticeably wet and paint is pulling away. We also have realized that flashing was not installed in windows that get a lot of rain. My question is this - although we are outside of the 1-year warranty - do we have any rights to repairs from the contractor? You should also know that there were other issues with this contractor that we did pursue with the contractors board and ultimately recouped some bond money. Those were issues that were discovered within the 1-year period. This is a new issue that because of the harsh rain we've received has just shown itself. Thank you.
OregonWe are a General Contractor and the owner has disallowed The project manager's cost because under cost of work definition it states that home office personal are not considered under cost of work.
We followed the matrix for General conditions outlined in the specifications and gave a breakdown of the PM cost.
We believe that General Conditions are not to be considered as cost of work.

OregonI was hired to hang tape an spray 2 different 2 bedroom apartments an was suppose to of gotten a check by the 15th of December. on the 10th of December I was ask to assure him I will be there to do any punch list that needed to be done an told him if you can get my check to me by the 15th of December then I will personally be there to take care of it. well didn't here from him till the 23rd of December an told him I was on another job an couldn't get there until 25th or 26th.on the 25th I texted him an told him I will meet him between 730 an 8 in the morning to go over repairs. he text me back an said no I got some one else to take care of it. well now he says that the owner said that he hasn't seen a worst job in 20 years an he is not cutting me a check for either apartment.
OregonOregon state requires a labor only breakout total, but we also use subs in our work. How does this get handled when there is only one field for the labor only total and no other line items to account for subs. Considering we don't always know what part of their work is labor vs. materials, we just want to be sure we are as accurate as possible when sending liens.
