Hi, we filed a lien against a home owner who paid the money to the court (Nassau county, NY). Now the money is held by the treasury. I need your help to petition the court for a court order to release the money. One of LevelSet representatives replied to my email telling me that I should request your "satisfaction of lien" service, but I need one of your attorneys to petition the court because as I was explained by a court clerk, the fact that the homeowner paid money to the court does not mean that he won't fight with us. It just meant that he did not want the lien to be attached to the property. So, can your attorney take the proper steps?...Read More

I worked for a company named Tag Marshall. they build golf course hardware and software for golf courses, I installed everything for them and haven't received payment, Level set informed me that i need a lawyer to accept the docs due to my company not being a New York company. I understand that this isn't a construction job. I'm just down to the wire and 7 days have gone by during this process with me not knowing what to do and them helping me. The contractor used sand to fill 8-foot slope to build a pole barn garage upon. Contract called for gravel, compaction prior to building erection . Original contract for $21k, I gave $8K prior .Contractor dumped sand built on it and was gone in 2 days, then demanded balance. Sand washed out I withheld monies owed to repair, I had all sand around build removed as best could be and dirt and gravel brought in properly compacted and errosion blanketed and seeded. The contractor filed lein which fell off after 1 yr , now 4 yrs later the contractor is insisting on inspecting property and demanding money and having his lawyer demand 21K. I still need the floor jackhammered up and replaced. My questions: Does the contractor have a right to keep coming on property 4 years later and harrassing me. I live in Oneida County NY and contractors do not need to be licensed.Have I done the right thing ,to withhold and use that money to fix his wrongs? Thank you...Read More

Our crew was working on a residential remodel in mid-June. House value $ 650K. Our remodel contract was for some $ 420K. Large house in bad shape. Crew returned from a half-hour lunch break to see flames coming out of window of the room where they had been working. They responded admirably and used the extinguishers on site to control the fire, and called the local fire dept, who responded quickly and was able to put the fire out within an hour or so. Damage was contained to one room, as a result. Our insurance carrier and the homeowners' insurance company are still determining liability and damages, etc. Meanwhile, the homeowners have fired us. Not surprising and it's fine with us -- they were a pain. But they owed us about $ 50K at the time of the fire, and now that we've been fired, we feel we should be able to claim our overhead and profit, which makes brings homeowners' total owed to us to some $ 102K. Our contract calls for mediation as the way to resolve any conflicts that arise between us and the homeowner, with the mediator to be an objective third-party construction expert. Homeowners have since hired a sarcastic lawyer who wants us to return every dime the homeowners ever paid us. Impossible as we paid all labor and materials costs to date. Not sure what to do, but don't want them getting out in front of us. Do I file a lien, and if so, for which amount, the $ 50K they owed at the time of the fire or for the full amount of $ 100K ? Or, do I cajole them into mediation, file a suit claiming breach of contract, or.....??? Thank you....Read More

Customer is very rude and degrade my painters and was cursing and yelling at my painter. They walked out to avoid confrontation and I was called and gave the customer 2 options. To let us finish the work without the husband being there or we stop the work and pay us for what we did. A contractor sent me an unpaid invoice dated March 2021 for a work date of Jan 2021. Together with the invoice there a notice that they will file a mechanical lien on my single family home if I don’t pay. It is now May 2022, more than a year after can they legally still file a lien? hello, we are a material supplier and have a lien filed against a GC. The owner has gotten wind of it and has offered to pay the balance, to remove the lien off of their property. If the owner wanted to pay off the lien, do we have to notify or even get written permission from our customer (the GC) that owes us the money? Our concern is that can envision a situation where the customer may not want us to be paid because there is some issue regarding the goods we sold. If the owner pays us, the owner will probably go after our customer (the GC) for the money. Actually there could be something in the contract between our customer (the GC) and the owner which says that the customer has to pay off the lien and if not the owner can pay and then go after the customer for the money....Read More
