We are located in NY... A Contractor from Indianapolis, IN , Hired us to do Stone work in at the Aloft / Marriot hotel in Seacacuas NJ . He gave us deposits and such. But never paid the full amount owed on final payment. Claimed that hotel never released funds. Did some research and hotel finally opened up Nov. 30th of 2020 and we can not get in contact with the contractor at all. Please let us know what we can do in this situation. Thank you in advance!...Read More

My supply house is placing liens on my projects that I have been paying him on. I have not missed a month even with Covid. I have made payments of 10k if not more. But it is still not enough for him. He wants more money due to the outstanding balance of 200k. He just placed another lien on a job when I made payments and he cashed 2 weeks before. It feels more like extortion. I understand his frustration, I have proof of all payments and emails as well asking him to not do this since I am making payment. What do I do.? I also had never been notified either of the lien...Read More

Our kitchen remodel is almost complete. The new granite countertops were installed on 1/6/21. They are from the wrong granite slab that we picked out. I am withholding the amount for the countertops from the general contractor’s current invoice until we have an acceptable solution. If the granite company refuses to replace the countertops and I refuse to pay, should I expect a mechanic lien? What would be the best way to fight/discharge the lien?...Read More

I had a house renovated in NY state. General contractor was hired with a fixed price for the work. Unbeknownst to me, he subcontracted the work out. GC didn't fully pay the subcontractor. Sub Contractor has now put a mechanic's lien on my property and is charging me by the hour and it is more than the price that I contracted for originally. I'm in no hurry to sell. There is no equity in the house between the first mtg. and another lien already placed on the house so I don't think they will foreclose. Can I just ignore it and "wait it out" for a year or two until it expires? Thanks Jay B ...Read More

We are a subcontractor working for a General Contractor on a fire damaged condominium building in Rockland County, NY. The building contains 16 individual condominiums. 12 are being rebuilt from scratch on the existing foundation and 4 of them are being renovated - All due to the fire. The General Contractor has a contract with the Condo Association. We are not getting paid by the GC and the GC is not getting paid by the Condo Association. We want to file a lien on the project. Do we need to file against all 16 unit owners or can we just file against the condo association since the GC only has a contract with them and not 16 individual contracts. ...Read More

I supplied and installed materials on a commercial project. The GC withheld major portions of monthly payments or didn't pay at all. I was unable to pay my workers and vendors. Then the GC excessively back charged my contract for work I could or would not perform due to an unachievable expidited schedule due to the GC poor coordination and management. The GC demanded that I put a large unsatiable work force to meet the expidited schedule with the promise of payment then didn't pay. The GC said that the owner was slow in payment. How do I fight the excessive back charges and collect monies due to my workers, vendors and collect for outstanding extras and change orders?...Read More

We filed a claim in NY. It is being challenged on the basis that we did not go to arbitration first. Our contract terms have an arbitration clause for remedying disputes. On your resources, I noticed that claimants in NY cannot waive their lien rights in a contract. Does the arbitration clause in NY amount to a no lien clause?...Read More

Hello, the Client who broke the contract and refused to pay us (balance of $50-70k) after we painted (interiors) of the townhouse in NYC. Then he right away moved into the townhouse and threatened us, that if we sue him he will totally mess up us since we do not have a plumbing license ( Part of the contract was also renovation of the bathroom and I brought a licensed plumber. When the time came to do the bathroom he refused a licensed plumber and said we should do it since it was a minor thing - replacement of the tub and we did it ). He is renting the townhouse. Should we proceed with Mechanical Lien or it rather will hurt us even more? I do appreciate your reply. Thanks, ...Read More

I'm being told a story and I can't understand how she thinks she can save the house. If I'm being told the truth, she claims she has 2 foreclosures. One is from her company they used their house as collateral. She says they called in loan. She also claims she is in foreclosure on her personal mortgage. From my understanding she owes 55 thousands on the mortgage and the business loan was a half a million. She is in forbearance. She says she's is getting it until March wich my understanding is it ends December all home covid programs end. We live in long Island NY. So how is this house savable and also it will be left to her only child . Won't her get the lien debt if the house is willed to him? Please help me know the truth as it affects my life in unimaginable ways. Thank you....Read More
