I filed a Mechanics lien in Manhattan County on a commercial project back on December 20, 2019. I did not extend it prior to the 1 year anniversary. Am I still able to extend it, or file a new lien against the same company/dollar amount at this time?...Read More

While preparing our home for sale, I had asked a local contractor to assist me with redoing the chimney flashing for the wood stove. The labor amounted to 2.5 hours and materials were approximately $125 (1 bundle of shingles, some roofing sealant, roofing nails, ice and water shield). He never provided me an estimate (verbal or written) and did not invoice me prior to our departure from NY. Afterward, he sent me a text telling me the bill was $850.00. I still do not have an itemized invoice to this date. I expected $400.00 - $500.00, as his prices are generally higher than other contractors, but I didn't expect $850.00. I sent him a postal money order via Priority Mail for $450.00 with a letter and he is threatening to speak to the new owners and place a lien on the property. I honestly believe that he is bluffing, however I want to ensure that there is no real recourse here. I paid him an amount which seems to be fair for the time and materials, as my research indicates that this type of repair would run anywhere from $250.00 to $400.00. As I mentioned, he has still not produced a detailed invoice for the $850.00 he's asking for. I appreciate any advice you can provide. Thanks in advance for your time....Read More

I am a senior citizen and have a grant from my USDA mortgage holder to get some capital improvements in my home. The heating contractor was aware of this before the work was done to replace to rusted out baseboard heaters in my basement. At the time of work completion; namely 6pm on a Friday night, the contractor's helper turned on me and demanded full payment of nearly $500.00 for the work. I reminded hm that this was a grant project and that it wasnt me paying the bill. He went out in the driveway to his van and with his megaphone mouth, and in open earshot of the neighbors, began a conversation with his boss about this matter. The boss told the guy to either collect now or turn off my boiler. So the guy came back in and turned off my boiler. Not being stupid, I know full well what was done to this lone senior woman was not only horrendously abusive but totally illegal, and that payment terms are at least 10-30 days, not 10 seconds after the job is done 6 pm on a Friday night. Obviously I had no way of contacting my agent for a check at that time. This contractor needs to be criminally charged, fined, and forced to do a big chunk of community service so that he would NEVER dream of doing this to anyone ever again. Whom do I contact to get his ball rolling?? My agent brought the check on Monday morning and expressed how appalled she was at this treatment. I havent yet called him to come turn on the boiler and collect his check, but I will. Please dont suggest the attorney general. They have zero legal authority here and dont even rate a broom closet for an office in the state building in Syracuse. They are in some dark corner somewhere down the blvd. and are the equivalent of a bunch of girl scouts selling cookies. I am serious about the guy getting punished and getting it big time!!!! This happened in Marcellus NY...Read More

In general we always bill out retainage for our portion of work at the end of a project. We are always told when the project is at substantial completion retainage is released - but we have retainage bills that are nearing a year. What is the general rule of thumb? Should we file a lien if we get nowhere with release or reduction of retainage?...Read More

Rent to own house in 2010. The contract stated that we were to do all the repairs and upkeep for 4years and that money would be deducted from the price. We made a great deal of repair and upkeep; saving and recording all monies spent. In 2014 city came to take the property because the landlord never paid the taxes for 4 years. Entered into legations with the cit for the past 3 1/2 years. Our attorney failed to file the latest round of correct paperwork. We were evicted We would like to put a lien on the property for the amount that we invested in repairs and maintenance....Read More
