We are a subcontractor to a company on a commercial construction project. We have had issues getting paid by them before. The Pay Application we submitted over 30 days ago has not been paid. They say they have not been paid by the owner. I requested to know when they submitted their pay application to the owner, they have not answered that question. I am in Missouri. Their contract says that we will get paid when they get paid basically. I want to and have the right to know, by their contract, when they sent the pay app and when they get paid. We are the supplier and our customer is the sub contractor. In the state of Missouri I saw on Levelset's website that a notice needs to be filed but I couldn't find where it tells me the timing of when the preliminary notice needs to be sent. I did see that it mentioned the notice of intent is due 10 days before the lien but we aren't at that point yet. Going forward we will be submitting the job sheets in Levelset for this customer. Just trying to take care of some older jobs that didn't end up going through Levelset and want to make sure we didn't miss any of the deadlines....Read More

I've been mowing/property maintenance for this commercial property for over 2 years. The owner hired me for a landscaping project, paid for invoices for supplies and some other expenses during 2021 but when his final bill for the labor came in, he refused to pay the amount billed. That final invoice got to him in January or February of this year. I've sent him repeated letters, email, and visited with him through calls, texts, and in a meeting at the property. I sent him a demand letter that was to be paid in 10 days which was Friday, Aug. 5. He sent me a letter during that time again refusing but with no payment. He just doesn't want to pay for labor. I have obtained the paperwork from the circuit court to file a lien and want to make sure I have my ducks in a row. Does the 10-day demand for payment letter satisfy any 10-day notice to file lien? Do I have to file a notice to lien given my circumstances? (laborer) To have a solid lien that won't be rejected, and I am coming very close to the filing deadline, what needs to be included with the filing? Will my final invoice to that business, which is quite descriptive, be sufficient, along with a property description and the documentation that needs to be signed in front of a notary. Can you call or send me a bullet point list and/or an email to help me along? I am a small potatoes guy and can't afford levelset's options for a paid service, so I need to do as much as I can for free, or at my own expense. Thank you so very much!...Read More

I need to speak with someone who can help me out with a project in Missouri. It is a facility that equipment was installed in back in 2020 and the equipment has had issues from the beginning. We have went in and fixed issues, we have paid to have a contractor to come out to fix issues to help them get the facility running. We have received some payment but still owed about $85K. We sent a service tech out yesterday, July 21, 2022, to access the issues. We sent out warranty equipment in March/beginning of April. An Intent to Lien was sent out at one time but with all the issues we chose not to pursue and instead help to get the issues fixed. We have had the person sign documents saying he will pay when we do this, etc. and we have received some amounts, the most was $12K a few months ago.
