Hello, I work in an Accounting Department for a construction company. On most of our jobs, we are hired as the General Contractor. I am the person that collects a copy of the recorded NOC, files the NOFs we receive from subcontractors, as well as prepare and send lien waivers before payment is issued to subcontractors. I do have a question regarding the NOFs along with lien waivers. Say for instance we are working with an electrical company, ABC Electrical, and they get their supplies from 123 Electric. The NOF that we we would typically receive would be from 123 Electric, and it would state that the "undersigned is furnishing to ABC Electrical." Do I need to have any sort of full lien waiver signed by ABC Electrical for 123 Electric stating that once we pay ABC Electrical, they agree to pay 123 Electric? I am confident in the lien waivers that I send directly to subcontractors with that we have signed contracts with. What I am not so sure about is when we get NOFs from companies that our subcontractors are working with. We own a small asphalt paving company and recently received a Request for copy of notice of commencement. We have never seen this before or know what it is or what to do with it. I have researched this, and it looks like it is the property owners responsibility to get one for the project. We typically bid a job, then the customer accepts it, signs, and we file for permits if needed, then complete the job and invoice. Do I now have to get a NOC for each job? Can a General Contractor withhold project information (i.e. Property Owner contact information, etc) from a sub/supplier if the GC has a Non-Disclosure Agreement with the property owner? This is information we've tried to gather for a preliminary notice but they state they can't provide because of the NDA....Read More

State of Michigan - homeowner has a bathroom renovation completed. There is no Notice of Commencement recorded. House is being sold....title company is aware that there is an outstanding invoice for work . Invoice is dated from June 2019. Homeowner refuses to pay full invoice, alleging that the builder went beyond the original scope of the project and charged more without authorization or acknowledgment from the homeowner. No mechanics liens filed at this time, but builder is threatening to do so. I just received a Notice of Furnishing from a supplier of a sub that is doing work for my GC on a Home Remodel. I believe the sub wants a copy of the Notice of Commencement. Of course, I didn't know anything about an NOC! What protection am I affording myself if I file an NOC now?...Read More
