I need your opinion and hoping you could lead me in the right direction. I am a subcontractor in the State of Texas currently I am doing 318 apts in Texas for a company from TN. I have a contract to do the drywall and paint. The GC is telling me to do all the extras that he will pay me, but he don't want to sign any change order when I tell them I need to have a change order the superintendent refuse to sign because he tell me that he is not authorized to sign change orders. the PM tells me not to delay the job or he is going to bring another company to help me and they are going to paid the and deduct from my draw and retainage. back on May they hired another painter and use them to do touch-up in just one building and is all this time he refuse to tell me or give me details of how much is he paying this contractor he only tells me $46,000 a week later $125,000 then $168,000 I keep asking how can he pay so much to do t-up then he said they repaint the entire building. now the company they hired finish but the GC give me a touch-up list but I have to repaint the entire building again. is costing me another $30,000 I ask why I have to do the t-up for them he said because they did it by the hours. he told me last week that is not money left on the retainage of $230,000. Also is more to this they owe me $150,000 on extras. I just don't know if i have a case. other GC that I do business tells me to consult an attorney but to make sure is a construction lawyer. Started work in January, Finished in April. Checks been in the mail every week. (Person was a friendly acquaintance) I did the sprinkler work for the landscape contractor on a job. So I guess I am a second tier provider. According to your calculator I am 92 days late to file the 2nd month letter but I have 61 days to file a lien. I am not sure what that means or what I am supposed to do. Send a 2 month letter late? Send the 3 month letter soon after and then file a lien or have I lost the right to lien, having missed the first deadline?...Read More

My company was hired by an HOA of 350 single family homes in TX to paint curb address numbers on the front curbs of each dwelling. Terms stated in the proposal/quote were for 25% down and balance due upon receipt of invoice at completion. Work was performed over a 6 day period and final invoice delivered to our contact on the HOA board at the conclusion of work on day 6. I was told in writing that that time by the HPA board member that they would have their management company process the payment the following day. After following up each of the next 3 days with no response, I received an email from the HOA Board members stating that their management company was unavailable due to an office move and would not be able to process payment until the end of the week In addition, they included feedback in the email which for the first time mentioned concerns related to the work performed. Throughout the 6 days we were on site we were in regular communication with the board member regarding schedule and work status during which time we were told that everything looked great, Our deliverables were done to spec and of overall high-quality meeting or exceeding industry standards. We have offered to work with them on any perceived issues through our warranty process, however, we require payment in order to continue (a holdback of up to 20% of balance due would be acceptable by us to move forward, but they have yet to respond). What should we do at this point? Can we file a lien on the HOA for the $2700 they owe us?...Read More

In Texas, if a contractor was hired by the tenant (instead of property owner), or if a contractor was hired by a parent company of the property owner (company), would the contractor be entitled to lien? In Property Code, persons who is entitled to lien should be "under or by virtue of a contract with the owner or the owner's agent, trustee, receiver, contractor, or subcontractor." Do the owner's agent and contractor have to have directly contract with the property owner regarding this specific construction project?...Read More

Once I am clear on when we start counting the 90 days, my next question is: On non-residential projects, TX laws indicate the deadline is both the 15th day of the 2nd month, and the 15th day of the 3rd month, following each month in which work was performed and unpaid. (The 2nd month notice has to be sent only to the prime contractor.) Do we need to send out the monthly notice both the 2nd and 3rd months in order to perfect our lien rights?
