I am a subcontractor that put a mechanics lien on a property because we were not being paid. I am now being asked to provide the property owner with a waiver release in exchange for final payment. I sent the property owner a final conditional release waiver but he did not accept it and sent me a message from his lawyer which stated: "the document does not have the recorded Document Number. The lien is not yet identified as being recorded. Please ask for this information and it would be best if they provided a copy of the actual stamped recorded lien or receipt from the County Clerk identifying the Document Number." I sent them the recorded mechanics lien. I am not sure what to do next....Read More
We had a LIEN-MECHANICS/SUB place on our home by a horrible contractor. He did it just to make our lives miserable. The was in Jan. 2016. The lawyer we had at the time went in 2018 to court just after the 2 years was up. However, I went to look at Lake County and the Lien is still showing. How do I get this removed, we are listing our home in the next two weeks. I am not understanding how a lien abandoned by the contractor is still lingering now. I am concerned. Thank you....Read More
Hi there, once the homeowner has paid . what are the next steps? I did what i thought needed to be done. I sent payment to the Will County Recorder as instructed to release the lien as well as sent them a notorized release of lien document with what i thought was the proper info. I recieved the check back with a letter stating that they were rejecting it and gave me a list of reasons why.. One of them being that the document i sent wasnt a standard document.. what exactly is the "standard document" Help! Please!

The contractors that did work on my home did extremely bad work. About halfway into the work they were doing (completely tearing down and redoing my back porch) I realized they had not obtained any permits from the city. When I asked them about it, they told me they didn't need permits - which is untrue. After they realized I demanded permits for them to continue, they left, never came back and never responded to any of my calls, emails or letters. Shortly after, they put a lien on my home. But now, they are no longer in business. Can the lien be removed?...Read More

Well, I went thru an adversary proceedings over a tuition debt. The proceedings took over two years to get a ruling, in which the judge ruled in my favor. Now when I filed for bankruptcy it was only in my name not my husbands, but the case proved that I was the primary care giver for our kids. I discovered that a lien was placed on the property only in his name after I tried to refinance the loan to include money for needed repairs to the property....Read More
We signed an agreement for a contractor to do work on a property. We chose to cancel the contract. I want to know if there is a way that I can find out if that General Contractor has a lien waiver on my property. I need to pay them for the work that they have done, but want to make sure that once paid, I am free and clear from them.
Found that a financial institution buried a Lien within paperwork on my property. The obligation has been satisfied for over three year ago. I'e been in contact with the institution but they have been putting me off. What can I do to get them to file the paperwork and get the lien removed.
I am inquiring about removing a lien in Illinois. Here is the super short version of the situation. Contractor placed a lien on the house. I sent a Demand Letter under Section 34 of the Illinois Mechanics Lien Act. The contractor did not file suit within the required 30 days. The questions I have are:
1. Is there a way that I can remove the lien without taking the contractor to court?
2. How long will the process take?
3. What is the quickest way to get the issue resolved?...Read More
