Getting an Expired Lien Removed

IllinoisLien Releases

Found that a financial institution buried a Lien within paperwork on my property. The obligation has been satisfied for over three year ago. I'e been in contact with the institution but they have been putting me off. What can I do to get them to file the paperwork and get the lien removed.

Under Illinois mechanics lien law, §770 ILCS 60/35, a lien claimant must file a lien release within 10 days of receipt of a written demand to release the claim from the property owner.  You should send this demand by registered or certified mail with return receipt requested, so you have proof of mailing. If the claimant doesn't release the lien, you can petition the court to do so, however you need to send this demand beforehand. Failure to release the claim could subject the lienholder to penalties up to $2,500, along with court costs and attorneys fees for bringing the action for the release.
