I am a licensed design consultant in Georgia. I had a retainer contract signed and deposit paid. After 5 months of endless additions and delays - the affluent business owner refuses to pay. I filed a lien and lawsuit again him. The deposition is in days and court in a week. I am told,"THE PROBLEM IS THAT IF YOU ARE COLLECTING AS A "LICENSED" CONTRACTOR AND YOU ARE NOT A "LICENSED CONTRACTOR", YOU CANNOT COLLECT." I do not believe this is correct, but my lawyer will not read the link of your website I sent the map of "same mechanics lien rights" for Georgia.. Hello I am an HVAC Sub Contractor in GA. I am involved in a mess. I took on a project that Consisted of the installation of Ductwork for three HVAC systems in a Commercial application. The entire job was finished and Passed the Rough-in inspection, all but a minute few punch items. My GC had no problem paying me through the job until it was time to pay the final invoice. I had no time stipulation and didnt need one because I finished the job in a very reasonable time frame. Then after inspection he wants to say that I didnt do job well Although the. I file a breach of contract with my contractor , the case was dismissed with prejudice.the contractor did not have a counterclaim, He then put a lien on my property.The last day of work with him was June 15th 2019. Vendor has performed some work using the supplies and materials that I purchased with his help. He installed a faucet incorrectly. Basically, still broken. He shredded screens while pressure washing my house. Left the same screens off the house. Painted the windows shut. Left the doorbell loose and the weather stripping off. List of undone goes on. Painters company refuses to accept the agreed payment by check, demanded immediate payment in full by cash before completion of project and put a lien on bigger amount then agreed (the next business day after they claim the project completed) in order to extort money. Is there a grace period in which I am to suvmit a payment, especially if it is delayed by the Payee as my numerous requests for payment mailing address are ignored. No contract signed by the company. There is something that appears to be a work order, signed by me for the agreed amount paid by check and the receipt for partial payment. I am the general contractor who has done some work on a privately owned park and has a sub who is threatening to file a lien by tomorrow. Here are the details: We have released all of this sub's retainage except $5,000 to ensure he finishes some work. This is the deal he and I agreed upon about 30 days ago. We followed through with our end of the deal and cut the check for the $55k, and he has not done the remaining work as a part of his end of the deal. He is now threatening to file a lien if he is not paid by tomorrow. He claims the work is warranty item so he should be paid his retainage. The case could be made either way. Regardless, I know he will not come back out and finish if he gets paid the $5k. Plus we had a deal, followed through with our end and he is now not following through with his end. The sub has provided a signed and notarized final lien waiver back in 5/30/19. So it has been more than 90 days since the last work was performed by his crews on site. And more than 60 days since the retainage final lien waiver has been submitted. I'm not sure if thsi matters, but obviously we have filed our NOC and kept all the lien waivers throughout the project each month for this and every sub. Can he actually file a valid lien? If so, what does that even mean for a privately owned park? The client owns the park outright. They did use a construction loan for this project. Please advise. Thank you! ...Read More
