March 2019 signed a contract with roofer to tear off and replace roof. We had leaks, they said from Irma and would be covered by insurance. Early in August the crew left. Ran out of materials and would return. Soon after some workers came and said the company was out of business. They hadn't been paid in 3 weeks. Bill went over there and the doors were all locked up and sign on door said out of business. Not knowing what to do, we contacted a legit roofer. They came and finished the roof for us. In the beginning first contractor received between $31000.00 and $32000.00 for the first payment. I need to say that when they left they had completed approximately 75-80% of the roof. The final payment of $13000+ was to be paid when the roof completely done and inspected and all forms were sent to the ins co by them. Obviously they never completed the job, but in Nov. a letter arrived saying they have put a lien on our house for the final payment (which went to the roofer who actually finished the job). Levelset website here states "Mechanics lien claimants in Florida must record their mechanics lien within 90 days from the last day they provided labor, services or materials to a construction or renovation project." Yet Florida law appears to say it is 45 days once work has begun. 713.06(2) states "The notice must be served before commencing, or not later than 45 days after commencing, to furnish his or her labor, services, or materials, but, in any event, before the date of the owner’s disbursement of the final payment after the contractor has furnished the affidavit under subparagraph (3)(d)1." Question- We are the owners and GC on a renovation project. We have contracted with several sub contractors and some have contracts between $250,0000 and $500,000 dollars. When asked for a sworn statement. The sub provide a sworn statement indicating that all materials have been paid in cash. If the materials were paid in cash shouldn't the sub have cash receipts as evidence. What if the sub has lied. Are we exposed to the liability from the supplier even if he didn't post a notice to owner. I need the response as it is crucila to understand the legal consequences look forward to hearing from you. Hello I’m in a situation where a property was being sold. The association wasn’t allowing house to be sold because they need to correct something so they can remove lien and title company can issue new owner the title. My company was hired as a painter. Title company is suppose to pay us with the closing of the house. I made sure to write that one the contract. Title company sign the invoice by the contract was made to the pervious owners name. Well the house was sold. New owners are in and they are great people and have really nothing to do with this and they still haven’t received the title since association is taking their sweet time with doing inspection. It’s now been two weeks and I haven’t been paid by the title company even though all work was completed. Now My only problem is I’ve done lien to property but they usually go to the owner. My NTO was sent in the first 45 days of being on the job, but I didn't have owner information and couldn't find it. I sent the NTO to my customer, who is the GC. We're now past the 45 days to send the NTO, but if I can find the owner and resend the NTO, would that protect my job? Or am I out of luck as far as meeting my NTO requirement? Are there any provisions for amending an NTO after the deadline? Thanks....Read More

I hired a roofing contractor to make repairs to my roof. The result after signing the proposal contract and paying half the cost up front was the contractor abandoning the job, leaving behind incomplete, shoddy work. When contacting the contractor to inquire on when they would return, they stated the job was complete and demanded remaining payment. I sent several photos of damaged roof areas that were never repaired as agreed upon both verbally and in contract, along with damage they caused to the roof. The contractor broke tiles on the roof while at the property causing additional damage that requires further repair in addition to repair work remaining. The contractors response was demanding that everything was complete and to make payment or else it would be very bad for me. About a month later now, I received a certified letter in the mail on Saturday, stating that if I didn't pay them the other half of the balance shown on their contract within 5 days of receiving their letter, they would file a lien on my home and take action to have it foreclosed to take payment. I'm in need of a Law Firm that can assist me with this case of breached contract and threat imposed by this contractor.
