We are a facility maintenance company in New York. We have completed a scope of work for a location in Sarasota, Florida. How long do we have to place a lien on a store from the time job was completed?

In Florida, mechanics liens must be filed within 90 days from the date the claimant last furnished labor or materials to the project. This deadline applies to all project participants. While mechanics lien protection is broadly available in Florida, its worth noting that in order for mechanics lien protection to apply, there needs to be a permanent improvement to the property. Some types of work may or may not qualify as a permanent improvement for the purposes of mechanics lien applicability. Services like landscaping may be "permanent" in some cases, but routine maintenance does not qualify for lien protection. Likewise, there are improvements subject to a maintenance contract that may qualify for mechanics lien protection, but others that may not.
