How do I collect payment as a subcontractor?

I have a construction company and I did some work as a subcontractor but now that the job is complete he is no longer responding to me and hasn’t paid me. I don’t have a written contract, just text messages before I started, during, and after the job was done where he is asking me to give him some time to pay me. Do I have any recourse here in Colorado? He owes me more than $5,000.00. Thank you.

Typically, this would be a good time to consider filing a Colorado mechanics lien. However, under Colorado law, if the contract price is over $500, the contract must be in writing to be able to file a valid mechanics lien. Since a mechanics lien is unavailable, you may want to consider sending payment demand letters threatening legal action if you are unpaid. Particularly a claim for breach of contract and unjust enrichment against your customer.
