I have a lien on a property and just had the "new owner" tell me to stay off the property. I informed him that there is a lien on the property, and if he was aware of this. He said no, because the original owner and he decided to do a private sale without the title company and the new owner is financing it for 7 years and will receive the title then. What can I do in this situation? The owner is uninterested in paying the lien, which is valid, with alot of evidence to prove it. ...Read More

I am a subcontractor and filed a notice of intent on a project where the building is a government building owned by a city. I believe I put Commercial for the project type instead of State/County and now I'm concerned that my mechanics lien wont match the notice and it will get denied. On April 9th, 2020 we filed a partial waiver of lien for amounts paid so far on a large commercial project. On April 28th, 2020 we filed a Release of Notice of Furnishing Prof Services as the developer needed it for change of ownership within their company. I am the owner of a small licensed home improvement company in Virginia. We have a signed contract with a client who paid $3000 deposit. She had received all materials and has had some work performed. She canceled the check without notice and without making me aware of he unhappiness and when we returned to work on the other contracted projects she instructed us to leave her property and not return. The original agreement didn't require a building permit but what she had us do once the work began caused a riser to be taller than she wanted, she asked us to fix it but at that point she didn't have a permit we told her once she took care of that we'd correct the issue. She canceled the check and called out an inspector which of course found the step out of code. She won't let us repair it and has given the verbal no trespassing notice, she has all of building materials and is dictating what she wants to pay and when I can get paid and when I can get back the materials the she doesn't want to keep. ...Read More

On a 20 Day Preliminary Notice the “lender” section is only referring to an entity (bank, etc.) that provides funds for the construction “work” and does not refer to the lender who is providing the loan/mortgage of the building correct?...Read More

We are the roofing contractors who completed the roofing project for the homeowners rental property. We passed dry in inspection 9/16/20 and final inspection on 9/24/20. Homeowners are refusing to pay the remaining balance on their account due to work that they feel should have been done that was not indicated on their signed contact. We are more than happy to honor their warranty once their account is satisfied in full. We sent out our company's 5 Day Lien Notice certified mail to two different addresses which the homeowners refused to sign for. We then sent out Levelsets Notice to Lien. The homeowners lawyer has now sent us a letter stating "any attempt to lien the property will be met with a claim for fraudulent lien under Florida Statutes, Chapter 713."
