Our demolition group shows up to a project and demolishes an existing structure and our fee is $500,000. We are paid $450,000 but there is $50,000 of retention left to be paid at the end of the project. Lets say our last day on the job is in March of 2021 but the job lasts another 10 months and ends in January of 2022. We signed an agreement that says we will not get paid retention until the end of the job. What is our timeline to file that lien, is it 90 days from the last day we are on the job? Does that timeline extend to the end of the job in January of 2022? Appreciate it....Read More

We installed equip on 8/18/2021. Upon completion she advised our installers that she was recently involved in a vehicle accident where her car went into our local lake and her purse was lost including her phone and credit card that she was planning to pay us with. She was informed that she should receive a replacement in 7-10 days and therefore could pay us upon receipt of the replacement. She has not done so and is not responding at all. I sent the Notice of Intent to Lien but it "came back as refused, unclaimed, or undeliverable". I dont know what this means or what our options are at this point. Can we go and repossess the equipment for failure to pay?...Read More

We have a new customer who just signed three separate quotes and made three deposits. He is a contractor himself and immediately mentioned that he wants an Unconditional Waiver for Progress payment. I explained that our office policy is that we do not issue Unconditional waivers until the job (s) are completed but I am happy to complete and send the Conditional for Progress Payment, as is the recommendation of our Legal Team. He became very irritated and quoting legal jargon saying our legal team is wrong and this is common practice. I have never heard such practice and am wondering, in California, is there a situation where this would be considered Standard Practice, so that I can prepare my owners for the phone call with this customer/contractor?...Read More

I am a property owner who recorded a release bond on the general contractor's lien, which included amounts owed to subcontractors. I now have those subcontractors separately filing their own liens even though those amounts were already included in the general contractor's lien.
