I am a GC who helped complete a two house project in CA for an owner/builder customer. I have a signed contract for my services. I was not paid in full and am owed approximately $23,000.00 for project management. I was promised I'd be paid once the property was sold; It sold on approximately April 4th and I just recently found out. The customer has refused to pay me the balance. Can I still file a lien now that it's sold? The last materials reimbursement invoice was paid on 4/7/22 and the customer paid one of 5 outstanding invoices for project management on the same date (the management fee was a flat fee for the project and progress payments were billed monthly.) ...Read More

I placed a lien for money owed. I allowed it to expire and chose not to act on it and foreclose. The building owner is threatening to sue for allowing it to remain on the record. The money is still owed. I chose to not foreclose or file for removal because I dont want to spend a single dollar more on this. Am I obligated to remove the lien ? Can i be sued?...Read More

Hello - I am in need of help please. Lien #5873507 was administered against me last year on a property I own. I only found out about it just now because I am about to sell the property and it came back on title abstract. The lien is 100% fraudulent. I have tried reaching out to the person who put the lien on the property - found him via LLC lookup - and he responded initially then stopped and won't respond to me or the title company. I'm a commercial painting sub contractor working at a U of M building in Michigan. I'm completely done with the project since December 31, 2021 and have been paid for all except our 10% retention. The General Contractor is saying that the owner will not pay out retention until two change orders are dealt with for another sub contractor (not us). This project started back in early 2021 and I don't see that the Office Manager at that time sent a Notice of Furnishings. Do we have any lein rights to collect our balance?...Read More

I'm a property owner who hired a GC to build a house on my property. when the GC exceeded the total estimate for the house by $80K, I told him that I was terminating the current construction contract and offered him a new one. He refused this offer and refused to sign the Lien Release that I gave him, and packed his tools and left the job site. He sent me a last invoice for work done. There are 4 subs who are owed money on that invoice. Since I do not now trust the GC, I intend to pay the subs myself. I need a Lien Release that will give me peace of mind that these subs will not file a lien against me in the future. I have paid for the cost of construction myself there is no loan.
