A contractor, who was fully paid for the service to a home, does not pay a subcontractor and now the sub is chasing the owner for less than $1500 and threatening a lien. Does the homeowner have any protection or leverage to challenge the sub? It seems all that is available online is how to protect the sub. But I want to know how to protect me as the homeowner if I have proof the contractor was paid. ...Read More

I bought an item from Facebook a few months ago and suddenly lost my job due to unforeseen circumstances. The original payment plan was to pay the person monthly, in their words, "whatever I could afford". I was very upfront about my personal issues and made sure they knew when I could not pay them back. When i first bought the item they wanted me to sign a contract but never sent me anything of the sorts. Can they legally charge me interest without giving notice that it would be something they'd do in the event I could not give them any payment?...Read More

I am a homeowner in California. Our insurance company is in the middle of mitigation with a restoration company on their price they charged. This has been going on for 5 months of back and forth through emails with the two parties negotiating a price both are willing to settle on. The restoration company today threatened to put a lien on our home saying nothing has been settled yet. Here is where it gets even more complicated: I received a phone call a few weeks ago and have been in contact since with a special agent from the NICB who is investigating the restoration company for over charging clients and there are currently over 400 persons who have been over charged from the restoration company putting astronomical costs on their goods and services and then using scare tactics to collect payment. What should I do considering there is a case being built on the restoration company and the NICB waiting to see if the DA will proceed with the case? Thank you ...Read More

I need to speak with someone who can help me out with a project in Missouri. It is a facility that equipment was installed in back in 2020 and the equipment has had issues from the beginning. We have went in and fixed issues, we have paid to have a contractor to come out to fix issues to help them get the facility running. We have received some payment but still owed about $85K. We sent a service tech out yesterday to access the issues. We sent out warranty equipment in March/beginning of Apil. An Intent to Lien was sent out at one time but with all the issues we chose not to pursue and instead help to get the issues fixed. We have had the person sign documents saying he will pay when we do this, etc. and we have received some amounts, the most was $12K a few months ago. We need to know if we are still able to file a lien or file suit. Kristi Trinkle 402-537-9247 ktrinkle@mechsales.com ...Read More

We are a pool construction company and we had just finished the first stage (excavation) and received a check from the homeowner. He asked us not to deposit it until the following friday but when that day came around he asked to pay via a credit card instead and when I called to get a credit card he didnt answer. Over several weeks we attempted to contact him with no response. We then decided to deposit the check to see if he had the funds. After about a couple days it bounced. This started the first full week in June....Read More
